미 마이크로소프트(MS)사에 대해 손해배상을 요구하는 민간 집단소송이
22일 캘리포니아주 고등법원(California Superior Court)에 처음으로
제기됐다. 이 소송은 법무부가 마이크로소프트사를 상대로 제기한 독점소송과
관련해 제기된 첫 민간인 손해배상소송으로 앞으로 유사 소송들이 쏟아져
들어올 것으로 예상된다.
The suit, to be filed by three longtime class-action lawyers, will
accuse Microsoft of using its monopoly in operating systems software to
overcharge buyers of Windows 95 and Windows 98.
집단소송 전문변호사 3명은 마이크로소프트가 운영체제 소프트웨어를 독점해
윈도 95와 윈도 98 사용자들에 지나치게 비싼 가격을 물렸다고 주장하며 이로
인해 손해를 본 수백만 캘리포니아인들을 대신해 소송을 제기했다고 밝혔다.
The complaint does not estimate the financial impact to Windows users,
but the lawyers are seeking triple damages if the suit leads to an
eventual finding of financial harm.

않았으나 피해액이 확정될 경우 이의 3배에 달하는 손해 배상을 청구할

In consumer class actions, legal experts say, Microsoft has defenses
that will lessen its potential liability and present formidable
obstacles for plaintiffs.

For example, most computer users do not purchase Windows directly from
retail software stores in shrink-wrapped boxes. Generally, the operating
system is already loaded on personal computers when they are purchased.
An estimated 90 percent of Windows 98 users got it preloaded on new
machines.

The legal significance is that a 1977 Supreme Court ruling -- the
Illinois Brick Company vs. the State of Illinois -- declared that
indirect purchasers of goods could not recover damages in class-action
antitrust cases.

컴퍼니와 일리노이주간 소송에서 제품을 간접적인 방법으로 구입한 사람은

Since 1977, however, 18 states including California and New York have
passed laws allowing indirect purchasers to qualify for triple damages
in antitrust class actions.

판결뒤에도 캘리포니아주와 뉴욕주를 비롯해 18개 주에서 간접구매자도 반독
점 집단소송에서 3배의 배상을 받을수 있도록 허용하는 법률을 제정했기

The class action, which the lawyers plan to file in California Superior
Court in San Francisco, does not specify the number of members in the
class of both individual and corporate users of Windows. But Gross
estimated that the number in California was "at least 10 million," and
he said the suit covers Windows users since the introduction of Windows
95. The complaint does not estimate the financial damage to Windows
users in California.
이번에 제기된 손해배상소송에서 윈도를 사용하는 개인이나 기업 등 피해자의

Santa Clara, Calif.-based Yahoo, which closed down 13-3/8 to 212-3/4 in
regular trading before the news was released, soared 22-1/4 in after
hours trading, according to Instinet.

buying and selling domain names.

But most prices are far less. An entrepreneur in California demanded that
Morgan Stanley Dean Witter & Co. pay $75,000 for a name the brokerage
wants to use for its online stock trading service. Morgan Stanley offered
to pay $10,000.

In a few instances, the Doe suits have led to money damages -- a Texas
judge last year ordered a California man to pay an $8.3 million default
judgment for posting anonymous barbs on a Yahoo message board about
American Eco, a Texas-based conglomerate.
