To establish the adequacy and accuracy of information submitted in response to questionnaires
and other requests for information, the Department examines the records of the party that
provided the information and interviews company personnel who prepared the questionnaire
response and are familiar with the sources of the data in the response. This process is called
verification. The Department must verify information relied upon in making a final determination
in an investigation, or in an administrative review when revocation of an antidumping order is
properly requested. The Department also must verify information submitted in an administrative
review if an interested party so requests and no verification of the producer or exporter had been
conducted during the two immediately proceeding reviews of that producer or exporter, or if

If deficiencies in the petition cannot be corrected, the petitioner must be given an
opportunity to withdraw the petition. If the petition is not withdrawn, a FR notice of
dismissal is prepared instead of an initiation notice. That notice must contain a detailed
statement of the reasons for dismissing the petition. The preparation and review process
is the same as that for an initiation.
If a petition is withdrawn prior to initiation or dismissal, no action on the part of the DOC
is necessary.

IX. POST-INITIATION WITHDRAWAL

If a petition is withdrawn after the initiation of an investigation, a public interest
memorandum must be prepared indicating that the termination of the investigation is in
the public interest. Additionally, the ITC must be consulted and all parties must be
notified. A FR notice must be prepared and sent through the normal review channels.

The URAA identifies three specific instances in which the DOC would be expected to use
information from different segments of proceedings or different proceedings as follows:
(1) information from prior segments may be used in a sunset or changed circumstances
review of the same proceeding (section 777(b)(1) of the Act); (2) business proprietary
information from a sunset or changed circumstances review resulting in revocation may
be used in an investigation on the same merchandise from the same country initiated
within two years of revocation (section 777(b)(3) of the Act); and (3) information from a
terminated investigation may be used in a new investigation on the subject merchandise
from the same and another country within three months of termination of the prior
investigation (sections 704 and
734 of the Act).
UR 협정에서 상무부가 별개의 조사절차나 별개의 진행과정에서 정보를 이용
할 수 있는 경우로서 아래와 같은 3가지를 구별해 놓고 있다.

(3) 종결된 조사로부터의 정보는 이전 조사의 종결 3개월 이내에 동일국가
또는 다른 국가로부터의 동종의 상품에 대한 신규조사시 이용될 수 있
다. (법 제704조, 제734조)
The regulations governing the imposition of sanctions for APO violations are set forth at
19 CFR 354. The regulations articulate a standard for issuance of a warning of an APO
violation and address other situations described below. The regulations simplify the
procedures for investigating alleged violations and the imposition of sanctions, establish
criteria for abbreviating the investigation of an alleged violation, and set a policy for
determining when the DOC issues warnings instead of sanctions. The regulations revise
the provisions dealing with settlement to make them consistent with practice. The
procedures for withdrawing charging letters are also simplified. A sunset provision
provides for the rescission of charging letters.
19CFR354에서는 APO(행정보호명령)을 어겼을 경우의 여러 가지 제재수단
을 규정하고 있다. 여기에는 APO을 위반하였을 경우의 경고기준을 명시하고
있으며, 아래에서 설명할 기타 상황에 대하여 언급하고 있다. 또 위반이 의심
되는 경우에 대한 조사절차와 제재의 부과를 단순화하고 그 조사를 간략히
하는 기준을 설정하고 있으며 그리고 상무부가 제재 대신에 경고를 발할
경우 등을 결정하는 지침 등을 규정하고 있다. 이 규정으로 사건 해결에
관련된 조항 등이 관행과 일치되도록 수정된다. 행정명령을 위반하였을 때의
고발장을 철회하는 절차도 단순하게 되었다. 일몰규정은 고발장의 철회에
대해 규정하고 있다.

F20 정신분열증(Schizophrenia)

정신분열증성 장애는 대체로 사고 및 지각의 근본적이고 특징적인 왜곡과 부적절하거나 둔감한
정동이 특징이다. 경과중 특정 인지 결손이 유발될 수 있기는 하지만 명료한 의식 및 지적능력은
보통 유지된다. 가장 중요한 정신병리학적 현상은 사고 반향, 사고삽입 또는 철회, 사고전파, 망상적
지각 및 조절 망상, 영향 또는 수동성, 제3자로서 환자를 논평 또는 논의하는 환각적 음성, 사고
장애 및 부정증상을 포함한다. 정신분열증성 장애의 경과는 연속적일 수도 있고, 진행 또는 안정적
결손을 동반한 에피소드성일 수도 있으며, 완전관해 또는 불완전관해를 동반한 하나 이상의 에피소
드가 있을 수도 있다.
정신분열증의 진단은 정동성 장애보다 정신분열증이 앞서 있었다는 것이 명백하지 않다면 심한
우울증 또는 조증의 경우에 내려져서는 안된다. 명백한 뇌질환이 있을 때 또는 약물중독이나 금단
상태에서 정신분열증의 진단이 내려져서는 안된다. 간질 또는 기타 뇌질환이 있을 때 발전하는
유사한 장애는 F06.2에 분류하고 정신활성 물질에 의해 유발된 것은 4단위숫자.5에 해당되는
F10-F19에 분류해야 한다.

며, 매너리즘이 흔히 있는 정신분열증의 한 형태. 감정은 천박하고 부적절하다. 사고는 해체되며
언어는 논리가 정연하지 않다. 사회적으로 고립되는 경향이 있다. 보통 부정증상의 급속한 발달,
특히 정동의 단조로움 및 의지 상실로 예후(豫後)는 불량하다. 파과형 정신은 정상적으로 청소년
또는 젊은 성인에서만 진단된다.

F20.2 긴장형 정신분열증(Catatonic shizophrenia)
긴장형 정신분열증은 운동 과다증과 혼미, 자동 순종과 거부증 등의 양극을 달리는 정신운동성 장애
가 지배적이다. 부자연스런 태도 및 자세가 장기간 유지된다. 심한 흥분의 에피소드가 본 병태의
특징적 양상이다. 긴장형 현상이 꿈같은 생생한 영상 환각을 동반한 상태와 복합될 수 있다.

다. 만약 환자가 더 이상 정신분열증상을 갖고 있지 않다면 우울성 에피소드가 진단되어야 한다.
(F32.-)만약 정신분열증상이 현저하면 진단은 적절한 정신분열증의 아형 (F20.0-F20.3)에 머물러야
한다.
F20.5 잔류형 정신분열증(Residual schizophrenia)
정신분열증적 발달의 만성기로 반드시 비가역적이지는 않으나 장기간의 "음성" 증상을 특징으로
하는 초기부터 말기까지의 명백한 진행이 있다.
장애를 정신운동성 지연, 활동성 저하, 정동의 둔감, 수동성 및 주도권 부족, 언어의 양 또는 내용의
빈곤, 얼굴 표정, 눈접촉, 음성 변조 및 자세등 비언어성 의사 소통의 불량, 자기 관리 및 사회적
역할 수행 불량등이다.
