that documentation of a general policy issue relates to and is actually
considered in the context of a particular case, documents reflecting or
recording such policy are part of the record. For example, a memo discussing
DOC policy regarding release of information under administrative protective
order (APO) would not be part of the record of every case in which an APO
is issued unless that memo provided the basis for a decision on an APO issue
in that case.
특정사건과 관련되지 않거나, 특정사건과의 연관관계에서 만들어지지
않은 일반정책사안에 대한 논의는 행정기록에 해당되지 않는다. 그러나
일반적인 정책사안을 문서화한 것도 특정사건과 관련되거나, 실제로 특정
사건과의 연계관계에서 검토되고 있는 정도에 따라, 해당정책을 반영하거
나 기록한 문서는 행정기록의 부분이 된다. 예를 들면 행정보호명령에
따른 정보공개에 관한 상무부의 정책을 논의한 메모는 사건에서 행정보
호명령을 발하는 결정을 하는데 근거를 제공하지 않는 한, 행정보호명령
이 발령된 모든 사안에 있어서 행정기록이 되지 않는다.
A document prepared in the context of one investigation or administrative
review that addresses issues arising in another case is not part of the record in
that other case or administrative review unless the document is specifically
used or considered in the context of that other case. The analyst must
physically incorporate such documents considered or used in the record of
that case or administrative review.
특정의 조사나 행정재심과의 연관관계에서 작성된 문서는 비록 다른
사건에서도 일어나는 문제를 언급하였어도 그 문서가 다른 사건과의
연관관계에서 특별히 이용되거나 검토되지 않는 한 다른 사안이나 행정
재심에서 행정기록으로 되지 않는다. 분석관은 해당 사건이나 행정재심
의 기록에서 검토되었거나 이용된 문서들을 물리적으로 통합하여야 한다.
2. Documents prepared in the context of an investigation or administrative
review that do not relate to or address the issues involved in a determination
but are directed to a ministerial (support) function of the agency are not part
of the record. For example, the record need not include documents relating
to:
- travel arrangements for verification trips
- logistics for team meetings and concurrence meetings
- personnel issues
2. 조사나 행정재심사와의 연관관계에서 작성되었으나 판정과 관련된
문제에 관련되지 않고 단지 관련기관의 행정적 (지원) 기능과 관련
하여 작성된 문서는 행정기록에 해당되지 않는다. 예를 들면 아래
와 관련한 문서는 행정기록에 포함되지 않는다.
