The mutiny was staged in the high seas and the mutineers are
believed to have dumped the bodies overboard. The ship was found
adrift last Saturday off the coast of Japan and was towed into Tokyo
Bay by the Japanese maritime authorities. This terrible incident has
awakened us to the urgent need for appropriate measures to
safeguard the lives of seamen from the dangers posed by mutinies.
선상반란은 공해상에서 발생했으며 반란자들은 시체를 바다에 수장한 것
으로 믿어진다. 어선은 지난 토요일 일본 근해에서 표류중 발견되었으며 일
본 해양당국에 의해 동경만으로 예인되었다. 이런 참사소식을 접하면서, 우
리는 무엇보다 먼저 선상반란의 위험에 노출된 선원의 생명을 지켜 줄 수
있는 적절한 대책부터 시급히 세워야 할 필요를 느낀다.

The Korean maritime police have requested the Japanese authorities to
transfer the boat and the surviving crew into their hands for
investigation. But the Korean law enforcement authorities should also
participate in the initial investigation conducted in Japan in view of the
fact that most of the victims of the mutiny were South Koreans and the
fishing boat was virtually being operated by a Korean firm.
한국 해양경찰은 이를 조사하기 위해 일본당국자에게 어선과 생존선원을
인도해 줄 것을 요구하였다. 그러나 한국의 관계사법당국자들 역시, 대부분
의 희생자가 한국인이며 그 어선 또한 실질적으로 한국회사에서 운영하고
있음 을 감안하여, 일본에서 실시한 초동수사에 참가해야 한다.

Most importantly, the government needs to work out measures to
protect the nation's shipping industry with the focus on safety on fishing
boats. Communications between fishing firms and their ships need to be
more effectively maintained and naval and coast guard patrols and
guidance of vessels strengthened.
가장 중요한 것은, 정부가 어선의 안전에 초점을 둔 해운산업을 보호할
수 있는 대책을 마련해야 한다. 본사와 선박과의 통신이 보다 효과적으로
유지되어야 하며 해군과 해양경찰의 순찰과 선박의 지도가 강화되어야 한
다.
문제가 된 바다는 중국과 일본이 어업협정을 협상하면서 양국의 잠정조치수역
(일종의 공동어로구역) 으로 설정한 곳이다.
이곳에서 제3국 어선이 어떻게 조업하느냐는 복잡한 문제다.
그런데 중.일어업협정은 아직 발효가 되지 않고 있으니 다른 논리로 이를 살펴야
한다. 협정발효 전이니 이곳은 현재로는 유엔 해양법상의 새로운 질서가
채 마련되지 않은 '충돌지역' 이다.
