[比較] warrant, warranty, guarantee, guaranty
warrant와 guarantee는 같은 어원에서 온 이중어(doublet)로, 무엇이 안전한가 진짜인가를 가리키는 경우 흔히 바뀌어 쓰인다. warrant는 ‘어떤 물건이 겉으로 보기에는 똑같다, 주장대로 진짜다라는 보증을 하다’를 의미한다.

guarantee는 ‘어떤 물건이 주장하는 바와 같지 않은 경우에는 그것을 새로 바꾸어 준다, 또는 그 값을 물어준다고 서약함으로써 그것을 보증하다’란 뜻이다.

그러나 이 말은 광고문에 함부로 사용되어, 극히 조심해서 읽지 않으면 무엇이 보증되어 있는지 알 수 없다. warrant에는 또한 guarantee에는 없는 ‘정당화하다’(justify'의 뜻이 있다.

warrant와 guarantee는 명사로도 쓰이나 ‘구속영장, 체포장’의 뜻으로는 warrant만이 쓰인다. 이 뜻으로 흔히 사용되는 불쾌한 연상에서 ‘보증’ 따위의 다른 뜻으로는 이 말을 피하고, guarantee가 흔히 쓰이는 경향이 있다.
warranty는 명사로만, guaranty는 명사와 동사로 특별한 의미에 사용된다. warranty는 주로 법률 용어로, ‘매매 따위의 계약에 관련해서, 어떤 특별한 사항을 보증하는 약속’ 또는 ‘토지 증서에서 양도받는 사람이 상위의 권리를 가지고 소유권을 주장하는 제 삼자의 방해를 받지 않고 부동산을 자유로 향유할 수 있다는 것을, 양도하는 사람이 보증하는 서면 계약’을 의미한다. a warranty deed는 이런 계약이 명시된 증서, ‘하자 담보 증서’로 a quitclaim deed(권리 양도증서)와 구별된다. 보험용어로, warranty는 보험 계약의 무효로 되는 ‘보험 가입자가 행하는 진술, 계약서’를 말한다. 또한 영장(warrant, writ)같은 ‘사법문서’(judicial document)를 의미하기도 한다.
guaranty는 ‘보증’(warrant), '보증계약‘, ’담보(물)‘를 의미한다. 동사로는 ’보증하다‘(guarantee)의 뜻이다. 영국에서는 미국에서 guarantee를 사용할 문맥에서 guaranty를 많이 사용하고, 미국에서는 이 두 말이 가진 모든 용법에서 guarantee를 주로 쓰고 있다.
인권법 제정 human rights legislation → 먼저 '정당한 요구 [자격 , 이유], 권리, 인권, (재산에 대한) 권리, 이권, 수익권, 소유권을 의미하는 right를 알아야 한다. 그래서 '투표권'은 the right to vote이고 자동차 운전시 자주 쓰는 '우선권'은 right of way이다. 그리고 right에는 '올바름, ''정당성,' ' (도덕적, 법적인) 정의, 정도; (도덕적으로나 법적으로) 올바른 행위, 정당한 행위, 공평한 취급.'이라는 뜻도 있는데 미국에서 약 1950년대까지는 '왼손'은 '바르지 못한 부정한 손'이라 하여 어른들이 아이들에게 왼손을 못쓰게 했었다고.....
미국법은 소위 미란다원칙이라고 해서 형사사건의 피의자를 경찰에 수속할 때에는 피의자는 묵비권을 행사할 수 있고 변호사의 도움을 받을 권리가 있다는 것을 경찰이 피의자에게 알려준 다음에 구속을 하도록 하고 있다.

◆ guard, defend, protect, preserve
guard : 외부와의 격리에 중점을 둡니다. 따라서 protect와 같은 뜻으로 쓰일
경우도 있고, ~~이 달아나거나 없어지지 않도록 지키다 라는 두 가지 뜻으로 쓰 입니다.
