구두나 서면으로 ‘알리다’의 뜻에서 tell은 일반적인 말이며, inform(알리다, 통지하다)은 약간 격식을 차리는 딱딱한 말로, 한 사실이나 사정에 관한 지식을 어느 사람한테 직접 전하는 것을 강조한다.

관청계에서 inform이라고 하면, 정보, 지식의 일편을 주는 것뿐만 아니라, 그런 것을 알려 주었다는 것을 정보, 지식을 받는 이에게 통고하는 것까지도 말한다.

무슨 일을 inform한다면, 그저 알린다고 하는 경우보다 그 일이 한결 권위 있는 일이라고 보는 것이다. informed sources(권위 있는 소식통, 확실한 소식통)란 말은 신문에서 그저 소문(rumor, gossip)에 대한 완곡어로 쓰여지는 수가 흔하지만, 무슨 일을 단지 들은 사람보다는 믿을 만한 것이라고 일반적으 that this was their final notice.
acquaint를 ‘알리다’의 뜻으로 쓰는 것은 영국에서는 고문체이지만 미국에서는 표준적 용법이다.

warrant와 guarantee는 같은 어원에서 온 이중어(doublet)로, 무엇이 안전한가 진짜인가를 가리키는 경우 흔히 바뀌어 쓰인다. warrant는 ‘어떤 물건이 겉으로 보기에는 똑같다, 주장대로 진짜다라는 보증을 하다’를 의미한다.

guarantee는 ‘어떤 물건이 주장하는 바와 같지 않은 경우에는 그것을 새로 바꾸어 준다, 또는 그 값을 물어준다고 서약함으로써 그것을 보증하다’란 뜻이다.

warranty는 명사로만, guaranty는 명사와 동사로 특별한 의미에 사용된다. warranty는 주로 법률 용어로, ‘매매 따위의 계약에 관련해서, 어떤 특별한 사항을 보증하는 약속’ 또는 ‘토지 증서에서 양도받는 사람이 상위의 권리를 가지고 소유권을 주장하는 제 삼자의 방해를 받지 않고 부동산을 자유로 향유할 수 있다는 것을, 양도하는 사람이 보증하는 서면 계약’을 의미한다. a warranty deed는 이런 계약이 명시된 증서, ‘하자 담보 증서’로 a quitclaim deed(권리 양도증서)와 구별된다. 보험용어로, warranty는 보험 계약의 무효로 되는 ‘보험 가입자가 행하는 진술, 계약서’를 말한다. 또한 영장(warrant, writ)같은 ‘사법문서’(judicial document)를 의미하기도 한다.
guaranty는 ‘보증’(warrant), '보증계약‘, ’담보(물)‘를 의미한다. 동사로는 ’보증하다‘(guarantee)의 뜻이다. 영국에서는 미국에서 guarantee를 사용할 문맥에서 guaranty를 많이 사용하고, 미국에서는 이 두 말이 가진 모든 용법에서 guarantee를 주로 쓰고 있다.

Throughout the proceedings, counsel to
the parties frequently request meetings with the analysts and the managers in IA to
discuss issues as they develop. Prior to the final determination, interested parties
may request that hearings be held on the arguments addressed in the briefs
submitted by the parties. Copies of all written communication, and records of all
telephone calls and meetings with parties to the investigation are placed upon the
record of the proceeding.

Four other units in IA play an important role during the investigative phase of the
AD and CVD process: 1) the Office of Policy formulates and disseminates
policies which govern the administration of the AD and CVD laws, 2) the Office
of the Chief Counsel for IA (a unit of the General Counsel's Office rather than
ITA) provides comprehensive legal support and advice; 3) the IA Office of
Accounting analyzes and verifies cost information and works closely with case
analysts in the actual calculation of dumping margins and net subsidies; and 4) the
IA Central Records Unit maintains all official and public reading files, receives
and distributes all case-related computer tapes and written filings, and assists in
the preparation of court records. An organizational chart of IA, and an IA phone

Administrative Protective Order

An administrative protective order is the legal mechanism that controls the limited disclosure of
business proprietary information to representatives of interested parties. The Department
authorizes the release of proprietary information under administrative protective order only when
the representatives file a request in which they agree to the following four conditions: (a) to use
the information only in the antidumping proceeding, (b) to secure the information and protect it
from disclosure to any person not subject to an administrative protective order, (c) to report any
violation of the terms of the protective order, and (d) to acknowledge that they may be subject to
sanctions if they violate the terms of the order. (Section 777(c) of the Act. See also Proprietary
Information and Proprietary Treatment.)

3. Information conveyed only orally is not part of the record. Keep in mind
again the need for completeness of the record. You must remember that

written memorandum describing the oral information if no other written
record will be made.

The use of business proprietary information by the Secretary is addressed in 19 CFR
351.306(a). The Secretary may disclose business proprietary information only to
1. An authorized applicant,
2. An employee of the DOC or the ITC directly involved in the proceeding in
which the information is submitted,
3. An employee of the Customs Service directly involved in conducting a
fraud investigation relating to an AD or CVD duty proceeding,
4. The U.S. Trade Representative as provided by 19 U.S.C. 3571(i),
5. Any person to whom the submitting person specifically authorizes
disclosure in writing, and
6. A charged party or counsel for the charged party under 19 CFR part 354.

Article 12 (Requirements for Mutual Cooperation)
Any judicial cooperation with respect to an entrustment by a foreign
country may be given only when it conforms to the following subparagraphs'

4. That the entrustment of service is made in writing specifying the name,
nationality, address or residence of the person to be served;

증인신문의 경우에는 신문받을 자의 성명·국적·주소 또는 거소와 신문사항을
기재한 서면에의할 것
5. That the entrustment of evidence examination is made in writing
specifying the party, summary of case, methods of evidence, or the name,
nationality, address or residence of the person to be inquired and matters
to be inquired, in a case of witness inquiry;
6. 국어로 작성된 번역문이 첨부되어 있을 것
6. That a translation in the Korean language is appended; and

7. That the country to which the entrusting court belongs, guarantees the

This Agreement may be terminated at the option of ABC, effective
upon thirty(30) days prior written notice of termination given
to XYZ, in the following events ;
(i) Should XYZ become bankrupt or insolvent,
(ii) Should XYZ fail to meet the minimum annual purchase
requirements or otherwise fail to meet promptly any of its
obligations pursuant to this Agreement ; or
(iii) Should XYZ attempt to assign this Agreement or any
rights hereunder without ABC's prior written consent.

No assignment of this Agreement shall be valid without the
prior written consent of the other party hereto.

All waivers hereunder shall be in writing and the failure of
any party at any time to require the other party's performance
of any obligations under this Agreement shall not affect the
right subsequently to require performance of the obligation.
Any waiver of any breach of any provision hereof shall not
be construed as a waiver of any continuing or succeeding
breach of such provision or a waiver of modification of
the provision.

This Agreement constitutes the entire agreement between the
parties and supersedes all previous negotiations, representations,
undertakings and agreements heretofore made between the parties
with respect to the subject matter, and shall not be modified
except by the mutual agreement in writing by duly authorized
officers of the parties hereto.

(d) Abc referral Ads (“Referral Buttons”), each in connection with the Web site(s), media player(s), video content and/or mobile content that You designate, or such other properties expressly authorized in writing by Abc (including by electronic mail) (such other properties, “Other Properties”), and the Atom, RSS, or other feeds distributed through such Web site(s), media player(s), video content, mobile content and/or Other Properties (each such Web site, media player, video content, mobile content, Other Property or feed, a "Property").

You agree to comply with the specifications provided by Abc from time to time to enable proper delivery, display, tracking, and reporting of Ads, Links, Search Results, Referral Buttons, and Abc Brand Features (as defined in Section 12 below) in connection with Your Property(ies), including without limitation by not modifying the JavaScript or other programming provided to You by Abc in any way, unless expressly authorized in writing by Abc (including by electronic mail).

You agree to comply with the specifications provided by Abc from time to time to enable proper tracking and reporting of Referral Events in connection with Your Property.

You shall not promote or facilitate a Referral Event by any means other than displaying a Referral Button on the Property, unless expressly authorized in writing by Abc (including by electronic mail).

You acknowledge and agree that the Ads will be displayed on the Property in a video format approved by Abc, and that such Ads: (i) shall only be displayed in connection with the Property(ies) and non-advertisement video content (collectively “Video Media”), all of which is subject to review and approval by Abc in its discretion at any time; and (ii) shall only be requested in connection with end user initiated Video Media. In addition, You agree that You may only display one (1) Ad Unit within Your media player at any single time, unless otherwise approved by Abc in writing.

You may terminate this Agreement with or without cause at any time by sending written notice of your desire to cancel Your participation in the Program to Xyz-support@Abc.com.

Abc Confidential Information does not include information that has become publicly known through no breach by You or Abc, or information that has been (i) independently developed without access to Abc Confidential Information, as evidenced in writing; (ii) rightfully received by You from a third party; or (iii) required to be disclosed by law or by a governmental authority.

Unless otherwise agreed to by the parties in writing (including by electronic mail), payments to You shall be sent by Abc within approximately thirty (30) days after the end of each calendar month that Ads or Referral Buttons are running on Your Property or that Ads are running on Search Results Pages if Your earned balance is $100 or more.
쌍방이 서면 ( 이메일 포함 ) 으로 동의하지 않는 한, 귀하의 수익이 미화 100 달러 이상일 경우, Abc는 광고 또는 추천버튼이 귀하의 자산에 게재되거나 또는 해당 광고가 검색결과 페이지에 게재되었던 해당 월 말로부터 약 30 일 이내에 지불금원을 귀하에 보내드립니다.
In the event the Agreement is terminated, Abc shall pay Your earned balance to You within approximately ninety (90) days after the end of the calendar month in which the Agreement is terminated by You (following Abc's receipt of Your written request, including by email, to terminate the Agreement) or by Abc.

In no event, however, shall Abc make payments for any earned balance less than $10.

If You dispute any payment made under the Program, You must notify Abc in writing within thirty (30) days of any such payment; failure to so notify Abc shall result in the waiver by You of any claim relating to any such disputed payment.

The payments made under this Agreement are for use by You only and may not be transferred or in any manner passed on to any third party (i.e., distributed to Properties managed by You that require separate payments) unless expressly authorized in writing by Abc (including by electronic mail).

1.1 Your use of Abc’s products, software, services and web sites (referred to collectively as the “Services” in this document and excluding any services provided to you by Abc under a separate written agreement) is subject to the terms of a legal agreement between you and Abc. “Abc” means Abc Inc., whose principal place of business is at 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States. This document explains how the agreement is made up, and sets out some of the terms of that agreement.

1.2 Unless otherwise agreed in writing with Abc, your agreement with Abc will always include, at a minimum, the terms and conditions set out in this document. These are referred to below as the “Universal Terms”.

9.1 You acknowledge and agree that Abc (or Abc’s licensors) own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Services may contain information which is designated confidential by Abc and that you shall not disclose such information without Abc’s prior written consent.
9.1 귀하는 Abc(또는 Abc의 라이센서(licensors))가 ‘서비스’에 대한 모든 법적 권리(‘서비스’에 관한 모든 지적재산권을 포함 . 이러한 권리의 등록 여부를 불문하고 그러한 권리가 존재할 수 있는 모든 국가를 대상으로 함)를 가지고 있음을 인정하고 동의합니다. 또한, 귀하는 ‘서비스’에는 Abc가 비밀로 지정한 정보가 포함되어 있을 수 있고, 귀하는 Abc의 서면에 의한 사전 서면동의 없이는 그러한 정보를 공개해서는 안됩니다.
9.2 Unless you have agreed otherwise in writing with Abc, nothing in the Terms gives you a right to use any of Abc’s trade names, trade marks, service marks, logos, domain names, and other distinctive brand features.
9.2 귀하가 Abc와 서면에 의하여 달리 합의하지 아니하는 한, ‘약관’의 어느 조항도 귀하에게 Abc의 상호, 상표, 서비스표, 로고, 도메인 네임 및 기타 식별력 있는 브랜드 특성(brand features)을 이용할 수 있는 권리를 부여하지 아니합니다.
9.3 If you have been given an explicit right to use any of these brand features in a separate written agreement with Abc, then you agree that your use of such features shall be in compliance with that agreement, any applicable provisions of the Terms, and Abc's brand feature use guidelines as updated from time to time. These guidelines can be viewed online at http://www.abc.com/permissions/guidelines.html (or such other URL as Abc may provide for this purpose from time to time).
9.3 만일 귀하가 Abc와 별도로 서면 계약을 체결하여 이러한 브랜드 특성(brand features)을 이용할 수 있는 명시적인 권리를 부여받은 경우에는, 귀하는 그 계약, ‘약관’의 해당 규정 및 수시로 업데이트되는 Abc의 브랜드 특성 이용 가이드라인에 따라 그러한 특성을 이용하기로 합니다. 이러한 가이드라인은 http://www.abc.co.kr/permissions/guidelines.html(또는 Abc가 수시로 이 목적을 위하여 제공하는 다른 URL)에서 온라인 상으로 볼 수 있습니다.
9.6 Unless you have been expressly authorized to do so in writing by Abc, you agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
9.6 귀하가 명시적으로 Abc로부터 서면 승인을 받지 아니하는 한, 귀하는 ‘서비스’를 이용하는데 있어서, 어떠한 회사 또는 조직(기관)의 상표, 서비스표, 상호, 로고를 그러한 표장, 상호 또는 로고의 소유자자 또는 사용권자에 관하여 혼동을 일으킬 수 있거나 일으키고자 의도된 방식으로 이용하지 않기로 합니다.
10.2 You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically told that you may do so by Abc, in writing.
10.2 귀하는 복제, 수정, 2차적 저작물 작성, 역설계, 디컴파일(decompile) 또는 다른 방법으로 ‘소프트웨어’ 또는 그 일부의 소스코드를 추출하고자 시도할 수 없습니다(또한 어느 누구에게도 이를 하도록 허락할 수 없습니다). 다만, 법률에 의하여 명시적으로 허용되거나 요구되는 경우 또는 Abc로부터 서면에 의하여 특별히 허락받은 때는 예외로 합니다.
10.3 Unless Abc has given you specific written permission to do so, you may not assign (or grant a sub-licence of) your rights to use the Software, grant a security interest in or over your rights to use the Software, or otherwise transfer any part of your rights to use the Software.
10.3 Abc가 귀하에게 명확하게 서면 허락을 하는 경우 외에는, 귀하는 ‘소프트웨어’를 사용할 수 있는 귀하의 권리를 양도(또는 재실시권 (sub-licence) 허가)할 수 없고, ‘소프트웨어’를 사용할 수 있는 귀하의 권리에 대해 담보권을 설정할 수 없으며, 달리 ‘소프트웨어’를 이용할 수 있는 귀하의 권리의 어느 일부를 이전할 수도 없습니다.
13.2 If you want to terminate your legal agreement with Abc, you may do so by (a) notifying Abc at any time and (b) closing your accounts for all of the Services which you use, where Abc has made this option available to you. Your notice should be sent, in writing, to Abc’s address which is set out at the beginning of these Terms.
13.2 만일, 귀하가 Abc와 체결한 법적 계약을 해지하기를 원한다면, 귀하는 (a) 언제든지 Abc에 통지하고 (b) Abc가 귀하에게 이러한 선택을 가능하도록 한, 귀하가 이용하는 모든 ‘서비스’를 위한 귀하의 계정을 폐쇄함으로써 해지를 할 수 있습니다. 귀하는 이 ‘약관’의 앞부분에 기재된 Abc의 주소로 서면에 의한 통지를 하여야 합니다.
14.5 NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM GOOGLE OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
14.5 귀하가 Abc로부터 또는 ‘서비스’를 통하여 얻게 되는 구술 또는 서면에 의한 조언 또는 정보는 ‘약관’에 명시적으로 기재되지 아니한 어떠한 보증도 성립시키지 아니합니다.
20.2 The Terms constitute the whole legal agreement between you and Abc and govern your use of the Services (but excluding any services which Abc may provide to you under a separate written agreement), and completely replace any prior agreements between you and Abc in relation to the Services.
20.2 ‘약관’은 귀하와 Abc 간의 최종합의사항으로서 귀하의 ‘서비스’(다만, Abc가 별도의 서면 계약에 따라 귀하에게 제공하는 다른 서비스는 제외됩니다) 이용을 규율하며, ‘서비스’와 관련된 귀하와 Abc 간의 모든 사전 합의사항을 완전히 대체합니다.
