Asked when they feel satisfied with their life, most people say they feel so when they think they are superior to others.

If we spend most of our time thinking only about those who have more, it's no wonder that we feel unhappy.
When we are surrounded by only those who have less, we feel grateful.
Even though we have exactly the same life either way, our feeling about our life can vary tremendously based on who we compare ourselves with.

이는 담합된 가격과 비교할 가상경쟁가격을 책정할 때 비교대상인 기간 중에 시장이 변동된 사정이 있을 경우 비교대상기간에서 제외해야 한다는 취지의 첫 판결이다.

Separate Rates

For nonmarket economy cases, the Department normally calculates one rate for all exporting
companies. However, if an exporter demonstrates that its export activities are independent of
government control, it can receive an individually calculated antidumping duty rate. This
separate rate is calculated using the U.S. price the exporter set and the inputs of the manufacturer
that supplied the goods to the exporter, valued in a surrogate country. All companies that do not
submit a response to the antidumping questionnaire or do not adequately establish that their
export activities are independent of government control are subject to the single economy-wide
rate.

비시장경제의 경우 상무부는 통상 모든 수출자에 대해서 단일의 덤핑
률을 산정한다. 그러나, 어떤 수출자가 수출활동에 있어서 정부통제를
받지 않는다는 것을 입증하는 경우에는 개별 덤핑률을 적용 받을 수
있다. 이 개별율은 동 수출자의 대미 수출가격과 제조업체의 생산요소에
비교대상국의 생산요소가격을 적용한 가격을 이용하여 산정한다. 질문서
에 대해 답변을 하지 않거나 수출활동이 정부의 통제를 받지 않고 있다
는 것을 입증하지 못하는 업체는 단일율을 적용 받게 된다.
Surrogate Country

For nonmarket economy cases, the Department values factors of production in a surrogate
country. The surrogate is a market economy country that is at a level of economic development
comparable to that of the nonmarket economy country and is a significant producer of the subject
merchandise or comparable merchandise nonmarket economy country. The Department cannot
use price or costs inside a NME, except in the case of a Market Oriented Industry. (Section
773(c)).

비교대상국가(Surrogate Country)

비시장경제국의 경우 상무부는 생산요소의 가치를 비교대상국가에서
구하게 된다. 비교대상국가는 경제발전 정도에 있어서 비시장경제국과 비교
가능하고 비시장경제국의 조사대상 물품 또는 비교가능 물품의 중요한 생산
국이어야 한다. 상무부는 시장경제원리에 의한 산업인 경우를 제외하고는
비시장경제국가내에서의 가격이나 원가를 사용할 수 없다.
