대법원은 공사도급계약과 관련해 체결되는 이행보증보험계약에서 보험사고에 해당하는 수급인의 계약상 채무불이행이 있는지 여부는 보험계약의 대상으로 약정된 도급공사의 공사금액, 기간 등을 기준으로 판정해야 한다고 했다.
