placid는 흥분하지 않는 것을 가리키고, 혼란되지 않고(unruffled) 한결 같은(equable) 외모나 기질을 암시하며, 때로는 경멸적인 용법에서 우둔함(stupidity)을 암시하기도 한다.

peaceful은 소요(turbulence), 혼란(disorder)이 없는 것을 말한다.

크기와 유형이 각기 다른 여러 가지 사회공동체에 특이한 어휘·구문·어법의 형을 가리키는 말들이다.
language(국어)는 한 국민이나 민족의 일반적인 유형에 적용된다.
ex) The English language is common to the United States and the United Kingdom.
dialect(방언)는 한 국어의 변형으로 한 지역 또는 어느 특수한 집단에 한정되어 있고, 어휘·발음·어법·어형이 특이한 점에서 표준어와 다르며, 여러 세대, 여러 세기 동안 존속되어 오는 언어 형태를 가리킨다.
ex) the perennial controversy as to whether Scots is a language or a dialect(스코틀랜드어가 국어냐, 한 방언이냐에 관한 끊임없는 논쟁)
vernacular(토속어)는 크거나 작거나 일정한 공동 생활체 안에서 태어나서 거기서 자란 사람이 사용하는 자연스러운 형태의 구어를 가리킨다. 중세기 영국에서 교회·학문적인 저술에 쓰인 언어가 라틴어였을 때, the vernacular는 어느 한 고장의 본바닥 말을 가리켰다.
ex) translate the Bible into the vernacular(성서를 본토어로 번역하다)
속되지 않고 자연스러우며 친근한, 비록 아취는 없지만 힘차고 활력 있는 말이라는 뜻을 품는다. 또한 흔히 동식물 따위의 학명에 대해서 속명이라는 뜻도 가지고 있다.
jargon(직업어)의 어원적인 뜻은 a chattering of birds(새의 재잘거림)로, 외국인이 말하는 것처럼 알아들을 수 없는 영문모를 말에 적용된다. 지금은 주로 한 공동생활체 안에서 사용하는 같은 집단, 흔히 직업 집단이 사용하는 인위적인 언어의 형태 또는 서로 다른 언어를 사용하는 같은 집단에 속하는 사람들이 사무나 거래에서 의사를 전달하기 위해 고안해낸 특수한 언어의 형태를 가리킨다.
ex) The jargon of sports writers varies from nation to nation.(체육난 기자의 용어는 나라마다 다르다)
자기 전문 분야를 떠나서 표준 영어의 말과 표현이 있고 그것으로 일반인에게 한층 분명한 뜻을 전할 수 있는 경우에도 자기 직업의 특수한 표현을 쓸 때는 그것은 jargon이 된다.

legal은 성문법이나 그 시행에 관계가 있는 것, 또는 그에 합치하는 것을 가리킨다.
ex) legal rights/ a legal marriage
lawful은 법률의 문장의 측면보다 그 실질적 원칙에 합치하는 것을 암시하고, 전반적으로 법률에 위반하지 않는 것을 모두 가리킨다. legal은 언제나 공식적인 법에 합치하는 것을 의미하나, lawful은 주로 도덕적·종교적 계율에 합치하는 것을 의미하는 데 사용한다.
ex) lawful heir/ a lawful but shady enterprise(합법적이기는 하나 미심쩍은 기업)/ That man was not Miss. Kim's lawful husband.
licit는 무역·상업·개인적 관계 등에 법률에 엄밀히 합치하는 것을 가리키지만, licit or illicit(합법적이거나 위법적이거나)라는 구로 사용되는 경우말고는 흔히 사용되지 않는다. 특히 어떤 일이 이행·실행되어야 할 방식·절차에 관한 법의 규정에 엄밀히 합치하는 것을 암시하고, 법으로서 규정된 것에 관해서 쓰인다. 이를테면, a licit marriage(합법적 결혼)는 교회법(canon law)에 따라서 거행하는 결혼식에 뒤따르는 모든 선행조건과 모든 필요조건을 갖춘 결혼이다.
legitimate는 근본적으로 법률상 결혼한 부모에게서 난 아이에게 적용되지만, 또한 왕위·상속·재산 같은 것에 대한 법적 권리를 가진 사람에 관해서도 사용된다.
ex) the legitimate monarch/ the legitimate heir of an estate
또한 법으로서 인정되는 것만이 아니고, 관습·전통·권위자로서 인정·용인되는 것 또는 논리적으로 허용되는 것을 가리킨다.

refuse는 여기 나온 말 중에서 가장 폭 넓은 말로, 제조인·가공인·건축인·가정주부 등의 소유주가 무용한 것으로 여겨 내버리는 것을 가리키며, 그런 것이 남에게 용도가 있든 없든 상관하지 않는다.

waste는 거의 refuse만큼 뜻이 넓은 말이지만, 보통 그것을 만든 사람이 쓰지 않는 것으로, 용법·환경·사람에 따라서는 쓰일 수도 있는 것에 적용된다.

rubbish는 쓸모 없는 물질이 쌓여 있는 것·헐어빠진 것·못쓰게된 것·다 써버린 것·가치 없는 것의 더미를 말한다.

trash는 헐어빠진 것, 그 속에 든 유용한 것이 다 없어진 것, 다듬을 때 베어낸 것이나 잘라낸 것 따위, 중요하지 않은 물질임을 강조한다. 미국 일반 용법에서 trash 는 흔히 rubbish 대신 쓰여서, 처치해야 하는 폐물을 가리키지만, 두 말이 다 이 뜻으로는 동물성이나 식물성의 쓰레기를 의미하지는 않는다.
In its center stood the abandoned capitol building. Its steps were littered with trash.
영국에서라면 여기에 rubbish가 쓰일 것이다.
garbage는 어원적 뜻은 닭 따위의 「내장」또는 주로, 부엌·상점·시장 따위에서 나오는 식용에 부적당한 육류·채소 따위의 부스러기·찌꺼기 등을 포함하는 유기질의 쓰레기에 적용된다.

strong은 폭 넓고 가장 일반적인 말이며, 긴장·압력 따위를 지탱하는 힘, 질병·파괴에 저항하는 힘, 굳센 세력 뿐 만 아니고, 적극적으로 행사할 수 있는 힘을 가리킨다.

stout는 strong보다 뜻이 강한 말로 부러지거나 굴복하는 일이 없이 긴장·압박·파괴력에 저항하는 힘, 또는 혹독한 사용·극렬한 고통·유혹 따위를 이겨내는 힘을 가리킨다. 사람에게 적용되는 경우에는 보통 결의·완고·대담함을 암시한다.

sturdy는 생물·무생물이 굳세거나 건강하다는 것을 암시하는 성질을 나타내는 말이다. 크다든가, 맹렬하다든가, 매섭다든가 따위에서 오는 힘을 암시하지 않고, 건강하고 왕성한 성장·튼튼하고 단단한 짜임새·단호한 정신 따위에서 오는 내적인 힘을 암시한다.
sturdy oaks(faith)/ The little fellow has sturdy legs.
stalwart는 그 어원의 뜻 「토대」(foundation)가 보여주듯이 깊이 세워지거나 든든히 뿌리박힌 데에서 오는 힘, 난공 불락의 힘, 완전히 신뢰할 수 있는 힘을 암시한다. 사람의 체구·체력에 대해서 쓰이는 경우에는 대단히 센 힘을 언제나 암시하지만, 영웅 같은 골격이라든가 또는 큰 체격을 강조한다.

tough는 굳세고 굴하지 않는 그리고 파괴나 압력에 효과적으로 저항하는 짜임이나 정신에서 오는 힘을 암시한다. 따라서 활력보다는 내구력(hardiness)을, 딱딱한 것 보다는 저항하는 탄력성(elasticity) 또는 강인성(wiriness)을 강조한다.

wedding은 결혼을 공표하는 의식과 그에 따르는 축연 따위의 사교적 행사만을 가리킨다. 매우 정서적이고 감상적인 뜻까지도 품고 있다.

marriage는 보통 결혼의 의식을 가리키는 데에 쓰이는 단순한 말이다. wedding과는 달리 아무 감정도 품지 않은 말이다. 또한 의식으로서 시작되는 법적·정신적 관계를 가리키는 데에 흔히 쓰인다.

그리고 marriage는 결혼생활의 전 기간을 의미하기도 한다.

When it is not possible to base normal value and export price (CEP or CEP) on sales at the same
level of trade, the law provides, subject to certain conditions, for an adjustment to normal value.
However, where the Department establishes different functions at the different levels of trade,
but the data available do not form an appropriate basis for determining a level of trade
adjustment, the law provides for a limited adjustment in the form of the "constructed export price
offset." This adjustment does not apply in export price comparisons, and the Department will
make the adjustment only when normal value is established at a level of trade more remote from
the factory than the level of trade of the constructed export price. The offset is a deduction from
normal value in the amount of indirect selling expenses incurred in the comparison market. The
amount of this deduction may not exceed (i.e., it is "capped" by) the amount of indirect selling
expenses deducted in calculating constructed export price. (Section 773(a)(7)(B) of the Act and
section 351.412(f) of the regulations; see also Level of Trade, Level of Trade Adjustment.)

Contemporaneous Sales

In investigations, the Department normally compares average export prices (or constructed
export prices) to average normal values. The averages normally are based on sales made over the
course of the period of investigation. In administrative reviews of existing antidumping orders,
on the other hand, the Department normally compares the export price (or constructed export
price) of an individual U.S. sale to an average normal value for a "contemporaneous month."

The preferred month is the month in which the particular U.S. sale was made. If, during the
preferred month, there are no sales in the comparison market of a foreign like product that is
identical to the subject merchandise, the Department will then employ a six-month window for
the selection of contemporaneous sales. For each U.S. sale, the Department will calculate an
average price for sales of identical merchandise in the most recent of the three months prior to
the month of the U.S. sale. If there are no such sales, the Department will use sales of identical
merchandise in the earlier of the two months following the month of the U.S. sale. If there are no
sales of identical merchandise in any of these months, the Department will apply the same
progression to sales of similar merchandise.

Export Price and Constructed Export Price

Export price and constructed export price refer to the two methods of calculating prices for
merchandise imported into the United States. The Department compares these prices to normal
values to determine whether goods are dumped. Both export price and constructed export price
are calculated using the price at which the subject merchandise is first sold to a person not
affiliated with the foreign producer or exporter (the "starting price").

Generally, a U.S. sale is calculated as an export price sale when the first sale to an unaffiliated
person occurs before the goods are imported into the United States. Generally, a U.S. sale is
calculated as a constructed export price sale when the first sale to an unaffiliated person occurs
after importation. However, if the first sale to the unaffiliated person is made by a person in the
United States affiliated with the foreign exporter, constructed export price applies even if the sale
occurs before importation, unless the U.S. affiliate performs only clerical functions in connection
with the sale.

The Department makes adjustments to the price to the first unaffiliated customer in calculating
the export price or constructed export price. For both export price and constructed export price
the Department adds packing charges, if not already included in the price, rebated import duties,
and, if applicable, certain countervailing duties (not applicable for non-market economy cases).
Also for both, the Department deducts transportation costs and export taxes or duties (not
applicable for non-market economy cases). No other adjustments are made in calculating export
price. However, in calculating the constructed export price, the Department also deducts selling
commissions and other expenses incurred in selling the subject merchandise in the United States,
the cost of any further manufacture or assembly performed in the United States, and a profit
attributable to the U.S. sale. (Section 772 of the Act. and section 351.401 and 351.402 (b) of the
regulations)

Factors of Production

For nonmarket economy countries, the normal methodology for calculating normal value is not
appropriate. Instead, the Department constructs a normal value using the nonmarket economy
producer's factors of production. The factors of production include, but are not limited to, (1)
the hours of labor required to produce the merchandise, (2) the quantities of raw materials
employed, (3) the amounts of energy and other utilities consumed, and (4) representative capital
costs, including depreciation. These factors of production are then valued in a market economy
country that is at a level of economic development comparable to that of the nonmarket economy
country and is a significant producer of the subject merchandise or comparable merchandise.

Foreign Like Product

The term "foreign like product" refers to merchandise sold in the comparison market that is
identical or similar to the subject merchandise. When used in the questionnaire, foreign like
product means all merchandise that is sold in the comparison market and that fits within the
description of merchandise provided in Appendix III to the questionnaire. (Section 771(16) of
the Act. See also Identical Merchandise and Similar Merchandise.) There are no foreign like
products for nonmarket economy cases. Factors of production analysis is used to determine
normal values. (See Factors of Production.).

Section 702(c)(4)(A) of the Act requires the DOC to determine, prior to the initiation of
an investigation, that a minimum percentage of the domestic industry for the like product
supports an antidumping duty petition. In making this determination, the DOC and the
ITC must both apply section 771(10) of the Act which defines "domestic like product",
but they do so for different purposes and pursuant to separate and distinct authority.
Furthermore, the DOC's determination is subject to limitations of time and information.
This may result in different definitions of the like product, but such differences do not
render the decision of either agency contrary to law (see Initiation of Antidumping Duty
Investigation: Collated Roofing Nails from the People's Republic of China, the Republic
of Korea, and Taiwan, 61 FR 67306 (December 20, 1996)).

Sections 702(c)(4)(C) and 732(c)(4)(C) of the Act establish a special rule for determining
industry support if the petition is filed on behalf of a regional industry. In such situations,
we apply the same 50-and 25-percent domestic-industry-support requirements on the
basis of production in the alleged region. Thus, a petitioner need only show that domestic
producers or workers in the relevant region, as opposed to the entire United States,
support the petition (see Initiation of Antidumping Duty Investigation: Certain Steel
Concrete Reinforcing Bars from Turkey, 61 FR 15039 (April 4, 1996)).

Section 773(d) of the Act specifies a method of calculating NV using the special rule for
certain multinational corporations (MNC). The following three criteria must be met
before the MNC provision is invoked:

C. Privileged Information
The description of what the DOC considers to be privileged information for the purpose
of an AD or CVD proceeding is set forth in 19 CFR 351.105(d). This section explains

Section 135(b) of the Customs and Trade Act of 1990 ("The 1990 Mini Trade Bill")
specifically amended Section 777 of the Act to prohibit the release of customer names by
the DOC during any investigation which requires a determination under section 705(b) or
735(b) until either an order is published under section 706(a) or 736(a) as a result of the
investigation or the investigation is suspended or terminated (in other words, this
prohibition does not apply in administrative reviews or in any other segment of a
proceeding than the investigation). The specific language reads as follows: "Customer
names obtained during any investigation which requires a determination under section
705(b) or 735(b) may not be disclosed by the administering authority under protective
order until either an order is published under section 706(a) or 736(a) as a result of the
investigation or the investigation is suspended or terminated. The Commission may delay
disclosure of customer names under protective order during any such investigation until a
reasonable time prior to any hearing provided under section 774."

An APO is the legal mechanism by which the DOC controls the limited disclosure of
business proprietary information to representatives of interested parties. The DOC
authorizes the release of business proprietary information under APO when the
representatives file an application for APO access (FORM ITA-367) in which they agree
to be bound by the terms of the APO. Applicants must:

o use the information only in the segment of the proceeding in which it was
submitted or in which it is authorized for use,
o protect the information from unauthorized disclosure,
o report any violation of the terms of the APO, and
o acknowledge the sanctions that may be imposed should there be a violation of the
terms of the APO.

(3) Those provisions of this Constitution which prescribe the terms of office of public officials or which restrict the number of terms that public officials may serve, shall take effect upon the dates of the first elections or the first appointments of such public officials under this Constitution.
