merchandise subject to investigation, we have relied upon the four characteristics
mentioned above from the Diversified Products case and a fifth characteristics,
introduced byu the CIT in the Kyowa Gas case:

Diversified Products criteria (ultimate use, expectations of the ultimate purchasers,
channels of trade, and manner of advertising), the DOC found a significant overlap.

When examining the physical characteristics of products in the context of class or kind
analysis, the DOC looks for clear dividing lines between product groups, not merely the
presence or absence of physical differences between certain products.
등급이나 종류의 분석과 관련하여 물품의 물리적 특성을 조사할 경우 상무부는
단지 일정한 물품간의 물리적 차이의 존재부여만이 아니라, 물품그룹간의
명백한 구별기준을 찾는다.
Physical differences alone between the two product groups are not conclusive proof
of different classes or kinds. Sulphur Dies is an example of this type of analysis and
decision. (see Final Determination of Sales at Less Than Fair Value: Sulfur Dyes,
Including Sulfur Vat Dyes from the United Kingdom, 58 FR 7537 (February 8, 1993)).
In that case, the DOC decided that the subject merchandise constituted only one
class or kind.

Regarding further-manufactured memory boards contained in downstream products,
we determined that the downstream products themselves were not in the same class or
kind of merchandise and, therefore, could not be included in the scope.

The DOC is also required to make a like product determination as part of its analysis of a
petition. Section 771(10) of the Act defines a domestic like product as "a product that is
like, or in the absence of like, most similar in characteristics and uses with, the article
subject to an investigation." Thus, the reference point from which a like product analysis
begins is "the article subject to an investigation," i.e., the class or kind of merchandise to
be investigated, which normally will be the scope as defined by the petition. In Initiation
of Antidumping Duty Investigation: Collated Roofing Nails from the People's Republic
of China, 61 FR 67306 (December 20, 1996) (Nails from the PRC), the DOC found no
reason to find the petitioner's definition of the product "clearly inaccurate."

Accordingly, the petitioner's representations that there are clear dividing lines between
collated roofing nails and other collated and bulk roofing nails was accepted, and the
like product definition (which was the same as the definition of the class or kind in the
petition) as set forth in the petition was adopted.
따라서 collated roofing nails와 other collated and bulk roofing nails는
명백히 구별된다는 제소자의 설명이 받아들여졌고, 신청서에 나와 있는 대로의
동종물품 정의(신청서상의 등급이나 종류의 정의와 동일함)가 채택되었다

채무 전체가 상환되지 않은 default (채무 불이행)보다는 상황이 나은
상태인 selective default는 국제신용평가회사인 Standard & Poor’s
(S&P)사가 종전의 default 등급을 채권별로 약간의 차이가 발생하는
투자위험도를 분명하게 표시하는 데 한계를 느끼고, 이를 보완하기 위해
각국의 채무상환능력을 평가하는 등급을 새로 짜면서 만들어낸 항목이다.
S&P는 이 등급을 활용해 지난 99년 Russia의 장기 외화표시채권 등급을
강등시켜 이로 인해 Ruble화 가치하락과 inflation (물가상승)·외국인
투자자들의 불신 등 Russian economy 전반에 부정적인 영향을 끼친 바 있다.
Among the developing nations, S&P and Fitch, another international
credit ratings firm, downgraded Argentina’s sovereign ratings on
three different occasions as it was on the verge of a national bankruptcy.
Argentina also received a ratings downgrade from Moody’s, as well.
And on Nov. 6, S&P lowered Argentina’s long-term credit rating to
selective default (SD). Indonesia also received a downgrade due to
the default risks on $850 million it must redeem by next year.
