만약 국제무역위원회가 국내동종물품이 조사범위 내의 물품의 수입에 의하여
피해를 보지 않았다고 판정하면 그러한 수입품에 대한 조사는 종료된다.
이것은 국제무역위원회의 예비 및 최종판정에 공히 적용된다. 국제무역
위원회가 상무부의 물품 등급이나 종류보다 동종물품의 범위를 더 좁게
판정한 사례는 반덤핑 명령 중국산 Compact Ductile Iron Waterwork
Fittings and Glands, 58 FR 47117 (93. 9. 9.)에서 찾아볼 수 있다.
After terminating an investigation, you should notify the interested parties and the
embassy. You should also prepare e-mail instructions to Customs regarding the
termination of suspension of liquidation.
Recent cases where we have terminated the investigation after initiation include:
Termination of Investigation: Certain Carbon and Alloy Steel Wire Rod from Belgium,
59 FR 39324 (August 2, 1994), and Termination of Investigation: Class 150 Stainless
Steel Threaded Pipe Fittings from Taiwan, 59 FR 40865 (August 10, 1994).
조사 종결 후에는 이를 이해관계인과 대사관에 통보하여야 하고, 세관에 보낼
청산정지 종결지시를 준비하여야 한다. 최근에 조사개시 후 조사를 종결
했던 사건은 벨기에산 Certain Carbon and Alloy Steel Wire Rod, 59
FR 39324(1994. 8. 2.) 및 대만산 class 150 Stainless Steel Threaded
Pipe Fittings, 59 FR 40685(1994. 8.10.) 등이다.
Section 135(b) of the Customs and Trade Act of 1990 ("The 1990 Mini Trade Bill")
specifically amended Section 777 of the Act to prohibit the release of customer names by
the DOC during any investigation which requires a determination under section 705(b) or
735(b) until either an order is published under section 706(a) or 736(a) as a result of the
investigation or the investigation is suspended or terminated (in other words, this
prohibition does not apply in administrative reviews or in any other segment of a
proceeding than the investigation). The specific language reads as follows: "Customer
names obtained during any investigation which requires a determination under section
705(b) or 735(b) may not be disclosed by the administering authority under protective
order until either an order is published under section 706(a) or 736(a) as a result of the
investigation or the investigation is suspended or terminated. The Commission may delay
disclosure of customer names under protective order during any such investigation until a
reasonable time prior to any hearing provided under section 774."
1990년 관세무역법(Mini 무역법) 제135조는, 조사결과 제706조(a)나 제736조
(a)에 의거 명령이 발해지거나 혹은 조사가 정지 또는 종료될 때까지, 제705
조(b) 혹은 제735조(b)에 의거 판정이 필요한 어떠한 조사기간에도 상무부
에 의한 고객명단의 공개를 금지토록 30년법 제777조를 특별히 수정하였다
(다시 말해, 명단공개의 금지는 행정적 재심이나 조사전 절차에서는 적용되지
아니한다). 그 내용은 다음과 같다. "제705조(b)나 제735조(b)에 따라 판정이
요구되는 조사중에 획득된 어떠한 고객명단도 행정보호명령에 따른 조사결과
로서 제706조(a)나 제736조(a)에 따라 명령이 발해질 때까지 또는 조사가
정지되거나 종료될 때까지 행정당국에 의해 공개되지 아니한다. ITC는
제774조에 따른 청문회 전 합리적인 기간동안 행정보호명령하에 고객명단의
공개를 지연한다."
The URAA identifies three specific instances in which the DOC would be expected to use
information from different segments of proceedings or different proceedings as follows:
(1) information from prior segments may be used in a sunset or changed circumstances
review of the same proceeding (section 777(b)(1) of the Act); (2) business proprietary
information from a sunset or changed circumstances review resulting in revocation may
be used in an investigation on the same merchandise from the same country initiated
within two years of revocation (section 777(b)(3) of the Act); and (3) information from a
terminated investigation may be used in a new investigation on the subject merchandise
from the same and another country within three months of termination of the prior
investigation (sections 704 and
734 of the Act).
UR 협정에서 상무부가 별개의 조사절차나 별개의 진행과정에서 정보를 이용
할 수 있는 경우로서 아래와 같은 3가지를 구별해 놓고 있다.
(1) 이전 단계(segment)에서의 정보는 동일 건의 일몰재심사 또는 상황변동
재심사에서 이용될 수 있다. (법 제777조(b)(1))
(2) 일몰재심사 또는 상황변동 재심사 결과 철회로 결론난 건의 영업비밀
정보는 철회후 2년내에 착수된 동일국가로부터 동일상품에 대한 조사에
서 이용될 수 있다. (법 제777조(b)(3))
(3) 종결된 조사로부터의 정보는 이전 조사의 종결 3개월 이내에 동일국가
또는 다른 국가로부터의 동종의 상품에 대한 신규조사시 이용될 수 있
다. (법 제704조, 제734조)

제3조 ①이 헌법에 의한 최초의 국회의원선거는 이 헌법공포일로부터 6월이내에 실시하며, 이 헌법에 의하여 선출된 최초의 국회의원의 임기는 국회의원선거후 이 헌법에 의한 국회의 최초의 집회일로부터 개시한다.
Article 3
(1) The first elections of the National Assembly under this Constitution shall be held within six months from the promulgation of this Constitution. The term of office of the members of the first National Assembly elected under this Constitution shall commence on the date of the first convening of the National Assembly under this Constitution.
②이 헌법공포 당시의 국회의원의 임기는 제1항에 의한 국회의 최초의 집회일 전일까지로 한다.
(2) The term of office of the members of the National Assembly incumbent at the time this Constitution is promulgated shall terminate the day prior to the first convening of the National Assembly under paragraph (1).
제4조 ①이 헌법시행 당시의 공무원과 정부가 임명한 기업체의 임원은 이 헌법에 의하여 임명된 것으로 본다. 다만, 이 헌법에 의하여 선임방법이나 임명권자가 변경된 공무원과 대법원장 및 감사원장은 이 헌법에 의하여 후임자가 선임될 때까지 그 직무를 행하며, 이 경우 전임자인 공무원의 임기는 후임자가 선임되는 전일까지로 한다.
Article 4
(1) Public officials and officers of enterprises appointed by the Government, who are in office at the time of the enforcement of this Constitution, shall be considered as having been appointed under this Constitution: Provided, That public officials whose election procedures or appointing authorities are changed under this Constitution, the Chief Justice of the Supreme Court and the Chairman of the Board of Audit and Inspection shall remain in office until such time as their successors are chosen under this Constitution, and their terms of office shall terminate the day before the installation of their successors.
②이 헌법시행 당시의 대법원장과 대법원판사가 아닌 법관은 제1항 단서의 규정에 불구하고 이 헌법에 의하여 임명된 것으로 본다.
(2) Judges attached to the Supreme Court who are not the Chief Justice or Justices of the Supreme Court and who are in office at the time of the enforcement of this Constitution shall be considered as having been appointed under this Constitution notwithstanding the proviso of paragraph (1).
③이 헌법중 공무원의 임기 또는 중임제한에 관한 규정은 이 헌법에 의하여 그 공무원이 최초로 선출 또는 임명된 때로부터 적용한다.
(3) Those provisions of this Constitution which prescribe the terms of office of public officials or which restrict the number of terms that public officials may serve, shall take effect upon the dates of the first elections or the first appointments of such public officials under this Constitution.

The period of time before shares are owned unconditionally by an employee in an employee stock option plan. If his/her employment terminates before this period ends, the company can buy back the shares at their original price.
This Agreement shall become effective upon signing and shall
continue in full force and effect for a period of two(2) years
from the date hereof, unless earlier terminated pursuant to
Article xxxxx, and shall thereafter be automatically extended
for successive two(2) years unless, three(3) months prior to
the expiration of the term, a notice of intention to finally
terminate is given in writing by one party to the other.
본 계약은, 만약xxxxx조항에 명시된 조건에 의하여 조기 만료되지
않는 한, 쌍방의 서명과 더불어 2년 동안 유효하며, 만약 계약종료
3개월 전에 계약의 어느 당사자가 상대방에게 계약종료의 의사를

더 연장 된다.
This Agreement may be terminated at the option of ABC, effective
upon thirty(30) days prior written notice of termination given
to XYZ, in the following events ;
(i) Should XYZ become bankrupt or insolvent,
(ii) Should XYZ fail to meet the minimum annual purchase
requirements or otherwise fail to meet promptly any of its
obligations pursuant to this Agreement ; or
(iii) Should XYZ attempt to assign this Agreement or any
rights hereunder without ABC's prior written consent.
본 계약은 만약 아래의 사항들이 발생 할 경우 ABC가 XYZ에

(i) XYZ가 파산 및 지불 불능 상태 일 때,

(iii) XYZ가 ABC의 사전 동의 없이 이 계약의 권리를 양도하고자 할 때.
(x) create a new account to use the Program after Abc has terminated this Agreement with You as a result of your breach of this Agreement; or
10) 귀하가 본 계약을 위반하여 Abc가 본 계약을 종료한 후 프로그램을 이용하기 위하여 새로운 계정을 만드는 행위 ;
You may terminate this Agreement with or without cause at any time by sending written notice of your desire to cancel Your participation in the Program to Xyz-support@Abc.com.
귀하는 언제든지 이유여하를 막론하고 Xyz-support@Abc.com 으로 프로그램 참여 취소의사를 이메일로 서면통지하여 본 계약을 해지할 수 있습니다.
This Agreement will be deemed terminated within ten (10) business days of Abc's receipt of Your notice.

13.1 The Terms will continue to apply until terminated by either you or Abc as set out below.
