농업보조금 지급 철폐 등의 핵심적인 사안에 대한 자신들의 입장 차이가 너무
커 합의를 이끌어 내지 못하고 결렬됐다.

agriculture and services are to resume in Geneva in January but the
possibility of any breakthrough is much less likely.
통상 전문가들은 농업과 서비스 분야에 대한 협상이 내년 1월 제네바에서
재개될 예정이지만 어떠한 타결이 나올 가능성은 매우 적다고 전망했다.
보조금 밴드제 subsidy band system
U.S. AD and CVD trade remedies are designed to offset the amount of unfair
competitive advantage attributable to foreign price discrimination or subsidization.
These actions are in full accordance with the internationally agreed upon rules and
principles which are embodied in the Antidumping and Subsidies Agreements. These
Agreements were developed during the Uruguay Round of Multilateral Trade
Negotiations under the General Agreement on Tariffs and Trade (GATT). These
Agreements are intended to ensure that the AD and CVD laws of member countries
are implemented in a fair, transparent, and expeditious manner.
미국의 AD 및 CVD를 통한 산업피해구제제도는 외국의 가격차별이나
보조금에 기인하는 불공정한 경쟁의 이점을 상쇄하기 위해 마련되었다.
이러한 조치는 반덤핑 및 보조금협정에 서술된 국제적으로 합의된
규칙에 원칙과 완전히 부합된 것이다. 이러한 협정은 GATT하에서 다자
간 무역협상인 우루과이라운드중에 발전되었으며, 회원국의 AD, CVD
제도가 공정하고 투명하며 신속하게 시행되도록 구상되었다.
The U.S. AD and CVD laws are comprised of the following: Title VII of the Tariff
Act of 1930, as amended (19 U.S.C. 1671-1671h)(CVD); (19 U.S.C. 1673-1673h)(AD);
the legislative history to amendments of the Tariff Act including the
Statement of Administrative Action to the Uruguay Round Agreements Act (URAA)
which amended the law to conform with the Antidumping and Subsidies Agreements;
and IA's regulations (19 CFR 351).
미국의 AD 및 CVD법은 다음과 같이 구성되어 있다 : 1930년 관세
법 7편 (CVD : 19 USC 제1671-1671조 h ; AD : 19 USC 제1673-1673조 h),
WTO 반덤핑 및 보조금 협정과 일치시키기 위하여 우루과이라운드협정
이행법(URAA)에 대한 행정조치지침(SAA)을 포함한 관세법 개정내용, 수
입행정실의 규정(19 CFR §351).
Under the CVD law, IA investigates complaints that foreign governments are
unfairly subsidizing their industries that export to the United States. Examples of
unfair subsidies are tax benefits related to exporting or government-provided
low-cost loans targeted to specific companies or industries.
외국정부가 미국에 수출하는 자국의 산업에 대해 불공정하게 보조금을
지급한다는 제소가 있을 때 수입행정실은 상계관세법에 따라 조사한다.
불공정한 보조금의 실례로 수출관련 세제상 지원이나 특정기업 또는 산
업을 대상으로 한 정부의 저리융자 등을 들 수 있다.
While governments can take many actions which could be said to
confer benefits on their producers, not all of these actions
are viewed as countervailable subsidies. Generally, the benefit
must be limited to a specific group of firms or industries or to a firm's
export activities in order to be covered under this law.
각국 정부는 자국생산자들에게 혜택이 부여될 수 있는 여러 가지 조치
를 취할 수 있으나 이러한 모든 조치가 상계 가능한 보조금으로 간주되
는 것은 아니다. 일반적으로 상계관세법이 적용되려면 혜택이 기업 또는
산업의 특정그룹에 국한되거나 기업의 수출활동에 국한되어야 한다.
Four other units in IA play an important role during the investigative phase of the
AD and CVD process: 1) the Office of Policy formulates and disseminates
policies which govern the administration of the AD and CVD laws, 2) the Office
of the Chief Counsel for IA (a unit of the General Counsel's Office rather than
ITA) provides comprehensive legal support and advice; 3) the IA Office of
Accounting analyzes and verifies cost information and works closely with case
analysts in the actual calculation of dumping margins and net subsidies; and 4) the
IA Central Records Unit maintains all official and public reading files, receives
and distributes all case-related computer tapes and written filings, and assists in
the preparation of court records. An organizational chart of IA, and an IA phone

반덤핑 및 상계관세의 조사과정에서 수입행정실내 4개 부서가 중요한 역할
을 하고 있다. 1) 정책담당관실(Office of Policy)은 반덤핑 및 상계관세
관련법규에 대한 정책을 수립하고 배포하며 2) 수입행정실전담 수석자문

중앙기록관리반(IA Central Records Unit)은 모든 공식·공개열람자료를
유지하고 모든 사건관련 컴퓨터 테이프와 서면의견을 접수, 배포하며

②정당은 그 목적·조직과 활동이 민주적이어야 하며, 국민의 정치적 의사형성에 참여하는데 필요한 조직을 가져야 한다.
(2) Political parties shall be democratic in their objectives, organization and activities, and shall have necessary organizational arrangements to participate in the formation of political will of the people.
③정당은 법률이 정하는 바에 의하여 국가의 보호를 받으며, 국가는 법률이 정하는 바에 의하여 정당운영에 필요한 자금을 보조할 수 있다.
(3) Political parties shall be protected by the State as provided by statute and may receive subsidy for operation from the State as prescribed by Act.
④정당의 목적이나 활동이 민주적 기본질서에 위배될 때에는 정부는 헌법재판소에 그 해산을 제소할 수 있고, 정당은 헌법재판소의 심판에 의하여 해산된다.
(4) If the purposes or activities of a political party are contrary to the democratic basic order, the Government may bring an action for its dissolution in the Constitutional Court, and the political party may be dissolved by decision of the Constitutional Court.
