The alleged ``cyber-squatting'' case was filed at WIPO's arbitration and
mediation center on Thursday, a day after new rules aimed at curbing the
abuse of trademarks on the Internet took effect, according to a
statement.
WIPO는 3일 성명을 통해 이 분쟁은 '사이버스쿼팅(cyber-squatting)'과 관련된
것으로 인터넷상에서의 상표권 남용억제를 위한 WIPO의 새로운 규정이 발효된
지 하루만인 2일 WIPO의 조정 및 중재센터에 접수됐다고 밝혔다.
Cyber-squatting, a violation of trademark rights, refers to bad faith or
abusive registrations under which an address is reserved,often without
payment first, with the intent to be resold later.
도메인주소 등록 때 신뢰의 원칙에 반하는 등록이나 나중에 되팔 목적으로 일
단 등록시켜 주소만 확보하는 식의 등록 남용 행위는 사이버스쿼팅으로 상표권
침해행위로 간주된다.
Francis Gurry, chief legal counsel and WIPO assistant director general,
told Reuters: ``We expect a decision rapidly. It is done on the basis of
documents only, without a hearing.
``But if there is a significant volume of cases, we will gather the panel
members together to review them in batches.
``If some indications prove correct, there could be significant demand at
least initially,'' added Gurry, an Australian. ``Then there will be a
deterrent effect of the procedure which would discourage people from
cyber-squatting.''
WIPO의 프란시스 거리(Francis Gurry) 수석 법률자문관이자 사무차장은
"결정이 빨리 내려질 것"이라며 "이는 청문절차 없이 서류에 의해서만
내려지며 조정건수가 많을 경우에는 패널구성원 전체가 참여해 한꺼번에
심사한다고 밝혔다. 그는 "신청인의 어떤 주장들이 타당한 지 가려지면 상대방은
여기에 해명해야하는 등 상당한 부담을 안게 된다"며 "이 때문에 조정절차가
사이버스쿼팅을 억제하는 효과를 갖는다"고 설명했다.
