오늘은 날씨가 꼭 가을같다. 어젯밤 비가 내려서 그런지 모처럼
하늘도 높고 아침 공기가 촉촉했다. 아침 일찍 일어난다는 게
이렇게 기분이 좋은 건지 예전엔 미처 몰랐다. 오늘도 옆집
똥개가 짖는 소리를 못 들었다. 삼복 더위에 주인한테
잡혀먹었나? 쯧쯧..불쌍한 것. 질과 Neo Killer II 조조를 보기로
했는데 아직 시간이 많이 남았다. 그래도 방심하지 말고 일찍
서두르기로 했다.
It felt like a typical cool autumn day this morning. Thanks
to last night's rain, the sky was high and the morning air
was real fresh and moist. Never did I think getting up early
would feel this good. Again, I couldn't hear the next door
mutt barking his head off. Maybe the owner decided it was
time to eat old spot to mark the dog days of summer.
Tsk...Tsk... Poor mongrel. Jill and I would see the first
showing of Neo Killer II. I had plenty of time left, but I'd
better hurry not to be late again.
1. 오늘은 날씨가 꼭 가을같다.
우리말을 영어로 옮길 때의 기본은 '단어가 아닌 뜻'을 옮긴다는
것입니다. Today was like ... 식으로 영작을 하는 건 전형적인
콩글리시지요. 우선 우리말을 머리에 새겼으면, 그 뜻을 기반으로
영어로 '말'을 해야 합니다.
이 문장에서 주의깊게 볼 것은 주어지요. 우리말의 주어를 영어에
그대로 써먹으려고 해서는 안됩니다. 문법 시간에는 '이런 데서
비인칭 주어를 쓰는구나'라고 배웠으면서도 막상 영어로는
못써먹는 게 바로 '우리말의 주어'를 떨쳐버리지 못하기
때문이지요.
또 한가지 특징을 보자면 원문에 없는 typical이나, cool이니
하는 수식어가 들어갔다는 것입니다. 우리말의 '가을 같다'는
뜻을 전달하려면 영어로는 이런 수식어 정도는 붙여줘야 하지요.
겨울 같았으면 아마, typical cold winter라고 했겠지요. 이처럼
어느 정도 'creative'할 수 있으면 맛깔나는 영작이 나올 수
있습니다.
2. 어젯밤 비가 내려서 그런지 모처럼 하늘도 높고 아침 공기가
촉촉했다. 어젯밤에 비가 내려서 그런지… 영어로 옮기려면
어디서 손을 대야 할까요? 우선 뜻을 새기세요. '비가 내려서
그런지'는 다른 말로 '아마도 비나 내려서,' '비 때문에,' '비
덕분에'로 생각할 수 있습니다. Thanks to 정도는 고등학교때
외웠던 기억이 나시겠지요? 지난밤 비는 영어로도 last night's
rain 정도면 충분합니다.
영작에서는 가지치기도 중요합니다. 물론, 칼같이 정확히 옮기는
것도 좋겠지만, 그다지 중요하지 않은 문장 성분에 신경쓰다보면
잘 해 놓은 영어 작문도 이런 문장 성분을 끼워 맞추려다 망치게
되지요. 여기서는 '모처럼'이 예가 되겠네요. 이걸 영어로
옮기려고 잘된 문장에 끼워맞추려하지 마세요. 때로는 가지를 친
문장이 더 아름답고 깔끔합니다.
3. 아침 일찍 일어난다는 게 이렇게 기분이 좋은 건지 예전엔
미처 몰랐다.
'얼마전까지 아니었는데 이제야 ~했다' 에 해당하는 전형적인
표현이 never did I ~식의 부정 도치구문이지요. 도치를 하는 건
단순히 강조를 위해서입니다. 부정어도 부사지요. 부사가
문장앞으로 나가 도치가 되면 동사를 끌고 나가려 합니다. 부사와
동사는 불가분의 관계니까. 그런데, 동사는 못나가니까 조동사가
나가게 되지요.
Never did I dream you'd love me too.
너도 날 사랑할 줄은 꿈에도 미쳐 몰랐어.
이정도는 해야 놀랐다는 의미가 전달되겠지요. 원래 문장을
그대로 쓴다면,
I never dreamed you'd love me too.
밋밋하지요?
4. 오늘도 옆집 똥개가 짖는 소리를 못 들었다.
옆집 개가 짖는건 첫번째 일기부터 계속봤으니 영어로 뭐라고
하시는 줄 아실테구요. 똥개라는 표현도 mutt 또는 mongrel이라는
거 배우셨지요?
The next door mutt is barking.
이렇게 쉬운 문장을 barking his head off라고 썼습니다. 쉬운
문장이니까 약간 멋을 부린 것이지요. 머리가 떨어져나갈 정도로
짖는다지요? 아마 우리말이었다면, '동네가 떠나가라고 짖다'
정도일 겁니다. 응용을 해볼까요?
She cried her eyes out.
눈이 빠져라고 울었다.
She screamed her head off.
머리가 떨어져나가라고 비명을 질렀다.
근데 번역을 보고 외우면 나중에 거꾸로, '너무 울어서 눈이
퉁퉁불었다,' '귀청이 떨어져라 비명을 질렀다'는 우리 말 문장을
보면 위와같은 영어 문장이 나오지 못할 수도 있어요. 그러니까,
반드시 '의미'로 문장이나 표현을 받아들이고 새기시기 바랍니다.
5. 삼복 더위에 주인한테 잡혀먹었나?
어려운 말이 나옵니다. 삼복 더위. 미국에도 삼복 더위는 있지만
우리와는 개념이 좀 틀리지요. 우리는 삼복 더위에 개를
잡아먹지만, 미국에서는 개가 불쌍할 정도로 더운 날이라고
생각하지요. 그래서 dog days라고 합니다. 자 그럼, 삼복 더위에
잡혀먹는 건 영어로 옮기기 쉬운 다른 말로 하면 무슨 뜻일까요?
삼복 중 (초,중,말복) 한날을 기념해서 잡아먹었다. 쉽지요?
기념한다는 건 celebrate를 쓸 수 있겠지만 복을 이정도로 축제로
생각하는 사람은 없을 테니 mark 정도면 충분합니다.

오늘이 결혼 30주년이지요.
재미있는 단어가 하나 나오지요. Spot. 우리나라에서 가장 흔한
강아지 이름이 바둑이라면 미국에서는 spot이지요. 둘다
점박이라는 건 공통점입니다.
6. 쯧쯧..불쌍한 것.
쯧쯧… 이런 의성어는 모르면 못 쓰지요. 의성어는 대책이
없습니다. 나오는 데로 외워두든가 조그만 사전을 만드세요. Tsk.
Tsk. Mongrel. 똥개지요. 위에서 한번 mutt를 썼으니까 여기서는
다른 표현을 쓴 겁니다. 영어는 반복을 싫어하는 언어거든요.

조조. 또 어렵네요. 근데 다시 한번 보면 단순히 '1회'라는
말이니 the first showing이면 되지요. 미국에서는 1회 할인보다
matinee라고 해서 낮시간대 할인이 더 많습니다.The Neo theater
offers an extra discount for the matinee showtimes just
before 6 PM.
네오극장에서는 저녁 여섯시 이전 낮시간 대에는 표값이
할인되지요.
여기서는 긴 한문장이지만 영어로는 두 문장을 썼습니다. 이처럼,
우리말이 한문장이라고 해서 반드시 한문장으로 옮기려들지
마세요. 틀리기 십상입니다. 의미가 더 분명해질 것 같으면
언제든지 문장을 chop it off!
8. 그래도 방심하지 말고 일찍 서두르기로 했다.
방심하지 말자. 한영사전으로 달려가지 마세요. 여기서 방심하지
않는다는 건 '또 늦지 않기 위해서'의 뜻입니다. 우리는 지금
'단어'를 영작하는 게 아니고 '말의 뜻'을 풀이해서 영어로
전달하는 거잖아요?

When draft petitions are received, we usually require a minimum of five business days to
review the draft and to give substantive comments to the potential petitioner or its
counsel. Draft petitions are not discussed with anyone outside IA, the Office of the Chief
Counsel for Import Administration (CCIA), and the International Trade Commission
(ITC) other than the petitioner. Any inquiries concerning possible filings of petitions
should be responded to with a statement that no petition has been filed on the product.
Only when a petition has been filed officially can we indicate that the DOC is considering
a petition on the product. At the time of filing the draft, it is appropriate to ask the
petitioner what schedule, if any, it has for filing the official version of the petition. If you
receive this information, it should be given to your supervisor or program manager (PM)
and the director of IA's Office of Policy and Analysis immediately.

Color Negative Photographic Paper 의 예비판정(59 FR 16181, 94.4.6)과
인도네시아, 중국, 타이완산 Melamine Institutional Dinnerware Product
의 조사개시 결정(61 FR 8049, 96.3.1.)이 있다. 위에서 인용한 2가지
사건은 과거의 국내시장 활력성 검사(국내시장 판매가 제3국시장 판매의
5% 기준)를 활용하였다. 다국적기업에 관한 주장이 제기되면 감독관이나
프로그램관리자와 협의한다.
The following is a list of activities that you will need to perform during the
initiation/dismissal phase of your case. Before you start your analysis, always check with
your team leader or supervisor to ensure that there are no other significant activities that
you will have to address.
1. Insert appropriate information into the Lotus Notes case tracking system.
2. Check with the ITC analyst to determine that the petition was filed on the
same date with both agencies.
3. Determine the names of your team members from OP, CCIA, and, if
appropriate, OA. Ensure that they all have a copy of the petition, and advise
them of the date for the team discussion of petition problems.
4. Analyze the petition using the "Antidumping Investigations Initiation
Checklist" found in Section VII of this chapter. Also do a like product
analysis as described in part B of section IV of this chapter. See the like
product memo written for Nails from the PRC.
5. If a draft petition was previously filed and reviewed by another analyst,
determine whether problems identified at the draft stage have been corrected.
6. Meet with your team members to discuss problem areas in the petition.
7. Arrange a meeting for the team with your supervisor or PM to review problem
areas in the petition. Determine what issues need to be brought to the
attention of the OD.
8. Set up a meeting with the OD to discuss significant problem areas.
9. Prepare a memo outlining the significant problem areas for the OD's meeting.
Have the memo approved by your supervisor or PM, and submit it to the OD
the day before the scheduled meeting.
10. After the OD meeting, advise the petitioner of all deficiencies that need to be
corrected. Set a due date for submission of supplemental information that will
allow enough time for analysis and concurrence meetings with the OD and
DAS.
11. Begin to prepare the initiation package as described below.
12. Give the initiation package to your team members for comments and then to
your supervisor or PM once the team comments are incorporated.
13. Incorporate your supervisor's or PM's comments, and set up separate meetings
with the OD and DAS. Sometimes the OD will combine his/her meeting with
the DAS's meeting. Check with your supervisor to determine if this is
appropriate.
14. Place the initiation package in the formal review chain (see Chapter 12, I.E.
for review chain information).
15. If it is determined that the petition is not adequate and a dismissal is
warranted, see section VIII of this chapter.
다음 사항은 담당하고 있는 케이스를 조사개시/기각하는 단계에서

5. 신청서 초안이 전에 제출되어 다른 분석관이 검토한 경우 초안단계
에서 지적된 문제점이 교정되었는지 확인한다.
6. 신청서상의 문제점에 대한 토의를 위해 팀멤버들과의 미팅
7. 신청서상의 문제점을 검토하기 위한 감독관, 프로그램관리자, 팀원간
의 회의를 개최한다. 국장에게 보고할 문제점을 결정한다.
8. 중요 문제점을 토의하기 위한 국장과의 면담을 준비한다.
9. 국장과의 면담시 논의할 중요 문제점을 개관한 메모를 준비한다.
이 메모는 감독관이나 프로그램관리자의 동의를 받아 면담예정일자
전날에 국장에게 전달한다.
10. 국장과의 면담 후에 수정되어야 할 문제점에 대하여 제소자에게 알려
준다. 국장과 부차관보와의 면담 등에 필요한 충분한 시간을 가질
수 있도록 보충자료의 제출일자를 결정한다.
11. 다음에서 기술될 조사개시 조치의 준비를 시작한다.
12. 조사개시 조치 내용을 팀원에게 배포하고 의견을 받은 다음, 이를
반영한 조치내용을 감독관 및 프로그램관리자에게 배포한다.
13. 감독관과 프로그램관리자의 의견을 반영하고, 국장 및 부차관보와
별도의 면담을 준비한다. 때때로 국장과의 면담과 부차관보와의
면담이 동시에 실시될 때도 있다. 이렇게 하는 것이 타당한지
감독관과 협의한다.
14. 조사개시 관련 조치를 공식적인 검토모형에 배치한다.
(제12장의 IE를 검토모형자료 관련하여 참조)
15. 신청이 부적절하고 기각이 확실하다고 판정되면 이장의 제8절을 참조
한다.
In case of doubt as to whether a document should be included in the record, you may find
it helpful to check with your supervisor or program manager (PM) and to answer the
following questions:

The analyst should carefully consider the completeness of the record in light of this
section. As explained above, the official record must be complete and fully support all
decisions made in the case or administrative review. If no other documents exist to
support a decision, such as those examples listed above, the analyst should, in
consultation with the supervisor or PM, prepare a memorandum for the file, with support
documentation attached, to explain why a decision was made. Always consult with your
supervisor to determine the most up-to-date policy on completeness of the record.

An import compliance specialist or a financial analyst receives a "critical sensitive"
security clearance when he or she reaches the GS-11 level. This clearance allows these
individuals to view "CONFIDENTIAL" and "SECRET" government classified
information. If you are a GS-7 or GS-9 import compliance specialist or financial analyst,
you do not have an appropriate clearance to view "CONFIDENTIAL" or "SECRET"
information. If you are offered classified information for review, you must immediately
inform the person trying to give it to you that you do not have clearance to see it. If you
are a GS-11 and you are not absolutely certain that your "critical sensitive" security
clearance is in place, you must check with your PM before you accept government
classified information.

Business proprietary or publicly available information cannot be classified as national
security information even if submitted by a foreign government with a request for
confidentiality. However, never publicly disclose information for which a foreign
government or other person claims national security classification. Because such
information cannot be released, even under APO, it is difficult to base a decision on it.
Consult with your PM or case attorney should this situation arise.
영업비밀 또는 공개이용가능한 정보는 외국정부가 비밀을 요하며 제출

"FOR OFFICIAL USE ONLY" ("FOUO") is a government classification but not a
national security one. Documents that carry these designations are administratively
controlled. See ITA Security's Manual of Administrative Instructions, Section 5, for
more detailed information. In some instances, "LOU" or similarly classified material
(e.g. "EYES ONLY" cables with no other classification) may be classified as proprietary
information for our purposes. For example, company-specific import and export statistics
provided to the DOC by the Japanese government and transmitted to us via State
Department cable with "EYES ONLY" captions can be classified as proprietary. Check
with your PM before making such classifications.

should always consult with your supervisor, PM, or team attorney if you are in doubt
about the need to place a document in the administrative record for your investigation,
administrative review, or scope determination.

Public versions of business proprietary documents must include all text contained in the
submission that has not been otherwise claimed as business proprietary. Parties may
choose to either range or index numerical data. If parties choose to range numerical data,
the data must be presented in terms of figures within 10 percent of the actual number.
Where the number is so small that a range of 10 percent would be impractical, a range of
20 percent may be used upon receipt of approval from the DOC. Voluminous data, such
as computer printouts, may be summarized by ranging at least one percent of the data
included. Check with your supervisor or program manager (PM) if you receive a request
for an exception to the 10-percent-ranging rule.

A decision memorandum is then prepared by the APO office citing the arguments raised
by the parties concerning the possible release of the disputed data. The decision
memorandum is prepared for approval by the appropriate office director. Concurrence is
obtained from the program manager, team attorney, and APO attorney, as well as from the
team of analysts assigned to the case.
