Critics say companies are abusing this process to get the information
without any intention of pursuing their claims. They say companies
usually drop the lawsuit once they get the subpoenaed information from a
firm like Yahoo, content to either put a stop to negative online postings
or with finding out if one of their own workers is behind the missives.

Quantum3D, which produces serviceable but relatively unsexy chips for the
video gaming and training industries.

The story begins last spring, when Quantum3D's vice president of business
development, Smith, happened to read a magazine article about Offroad,
which was then aggressively publicizing itself.

With venture backing already from Chase Ventures, Charter Ventures and a
fund run by its acting CEO, Silicon Valley veteran Gordon Campbell,
Quantum3D could have raised money elsewhere. But the Quantum3D people
liked Offroad's pitch.
