U.S. AD and CVD trade remedies are designed to offset the amount of unfair
competitive advantage attributable to foreign price discrimination or subsidization.
These actions are in full accordance with the internationally agreed upon rules and
principles which are embodied in the Antidumping and Subsidies Agreements. These
Agreements were developed during the Uruguay Round of Multilateral Trade
Negotiations under the General Agreement on Tariffs and Trade (GATT). These
Agreements are intended to ensure that the AD and CVD laws of member countries
are implemented in a fair, transparent, and expeditious manner.

The identification of business proprietary information in submissions to the DOC is
addressed in 19 CFR 351.304(b). 19 CFR 351.304(b)(1) deals with the bracketing and
labeling of business proprietary information in general, and is consistent with the DOC's
past practice that requires that a person claiming business proprietary status for
information place single brackets ("[ ]") around the information. This paragraph also
requires that a person claiming business proprietary status for information must explain
why the information in question is entitled to that status. The paragraph further explains
that the submitting person must include an agreement to permit disclosure under APO,
unless the submitter claims that there is a clear and compelling need to withhold the
information from disclosure under APO.

Neither party shall be liable to the other party for nonperformance
or delay in performance of any of its obligations under the
Agreement due to war, revolution, riot, strike or other labor
dispute, fire, flood, acts of government or any other causes
reasonably beyond its control. Upon the occurrence of such
a force majeure condition, the affected party shall immediately
notify the other party of any further developments.
Immediately after such conditions are removed, the affected
party shall perform all obligations with due speed.

4. 계약당사자의 책임.
You are solely responsible for the Property(ies), including all content and materials, maintenance and operation thereof, the proper implementation of Abc's specifications, and adherence to the terms of this Agreement, including compliance with the Program Policies.

Abc reserves the right to investigate, at its own discretion, any activity that may violate this Agreement, including but not limited to any use of a software application to access Ads, Links, Search Results, or Referral Buttons or to complete any Referral Event, or any engagement in any activity prohibited by this Agreement.
Abc는 재량에 따라 본 계약 위반 관련 모든 행위 ( 광고, 링크, 검색결과, 추천버튼에 접근하거나 또는 추천이벤트를 완료하기 위한 소프트웨어 응용프로그램 (software application) 의 사용, 또는 본 계약에서 금지하는 일체 활동에 대한 개입을 포함하며 이에 한정되지 않음 ) 를 조사할 수 있는 권리를 보유합니다.
You may terminate this Agreement with or without cause at any time by sending written notice of your desire to cancel Your participation in the Program to Xyz-support@Abc.com.

(d) clicks co-mingled with a significant number of invalid clicks described in (a) above, or as a result of any breach of this Agreement by You for any applicable pay period.

Abc reserves the right to withhold payment or charge back Your account due to any of the foregoing or any breach of this Agreement by You, pending Abc's reasonable investigation of any of the foregoing or any breach of this Agreement by You, or in the event that an advertiser whose Ads are displayed in connection with Your Property(ies) defaults on payment for such Ads to Abc.

You agree that Abc may use Your name and logo in presentations, marketing materials, customer lists, financial reports, Web site listings of customers, Search Results Pages, and Referral Pages.

If You wish to use Abc's trade names, trademarks, service marks, logos, domain names, and other distinctive brand features ("Brand Features"), You may do so, so long as such use is in compliance with this Agreement and in compliance with Abc's then current Brand Feature use guidelines, and any content contained or referenced therein, which guidelines may be found at the following URL: http://www.Abc.com/permissions/guidelines.html (or such other URL Abc may provide from time to time).

You represent and warrant that (a) all of the information provided by You to Abc to enroll in the Program is correct and current; (b) You are the owner of each Property or You are legally authorized to act on behalf of the owner of such Property(ies) for the purposes of this Agreement and the Program; (c) You have all necessary right, power, and authority to enter into this Agreement and to perform the acts required of You hereunder; and (d) You have complied and will continue to comply with all applicable laws, statutes, ordinances, and regulations (including without limitation the CAN-SPAM Act of 2003 and any relevant data protection or privacy laws) in Your performance of any acts hereunder.

In addition, to the extent that Your Site is a media player (1) You represent and warrant that You have a valid license to use and distribute such media player (including all content therein, including without limitation any Ads or Ad Units) for the purposes of this Agreement and the Program; and (2) You shall ensure that any media player(s) that constitute the Site shall comply with the terms and conditions set forth herein. You further represent and warrant that each Property and any material displayed therein: (i) comply with all applicable laws, statutes, ordinances, and regulations; (ii) do not breach and have not breached any duty toward or rights of any person or entity including, without limitation, rights of intellectual property, publicity or privacy, or rights or duties under consumer protection, product liability, tort, or contract theories; and (iii) are not pornographic, hate-related or otherwise violent in content.

1.2 Unless otherwise agreed in writing with Abc, your agreement with Abc will always include, at a minimum, the terms and conditions set out in this document. These are referred to below as the “Universal Terms”.
1.2 Abc와 서면으로 달리 합의하지 아니하는 한, 귀하와 Abc의 계약은 언제나 이 서면에 기재된 계약조건을 적어도 포함하게 됩니다. 이러한 계약조건을 아래에서는 “일반약관”이라고 지칭합니다.
1.3 Your agreement with Abc will also include the terms of any Legal Notices applicable to the Services, in addition to the Universal Terms. All of these are referred to below as the “Additional Terms”. Where Additional Terms apply to a Service, these will be accessible for you to read either within, or through your use of, that Service.

1.4 The Universal Terms, together with the Additional Terms, form a legally binding agreement between you and Abc in relation to your use of the Services. It is important that you take the time to read them carefully. Collectively, this legal agreement is referred to below as the “Terms”.
1.4 ‘일반약관’은 ‘추가약관’과 함께, 귀하의 ‘서비스’ 이용과 관련하여 귀하와 Abc 간에 법적 구속력이 있는 계약으로 성립됩니다. 귀하는 이러한 계약 조건을 충분한 시간을 가지고 주의 깊게 읽으시기 바랍니다. 이러한 법적 계약을 아래에서는 총칭하여 “약관”이라고 합니다.
5.3 You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by Abc, unless you have been specifically allowed to do so in a separate agreement with Abc. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Services.
5.3 귀하는, Abc와 별도의 계약을 통하여 명시적으로 허락을 받지 아니하는 한, Abc가 제공한 인터페이스를 통하지 아니하는 다른 수단에 의하여는 ‘서비스’에 접속(또는 접속시도)하지 아니하기로 합니다.
5.5 Unless you have been specifically permitted to do so in a separate agreement with Abc, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose.
5.5 귀하가 Abc와 별도의 계약을 통하여 명시적으로 허락을 받지 아니하는 한, 귀하는 어떠한 목적으로든지 ‘서비스’를 복제, 재생산, 복사, 판매, 이전 또는 재판매를 하지 아니하기로 합니다.
9.3 If you have been given an explicit right to use any of these brand features in a separate written agreement with Abc, then you agree that your use of such features shall be in compliance with that agreement, any applicable provisions of the Terms, and Abc's brand feature use guidelines as updated from time to time. These guidelines can be viewed online at http://www.abc.com/permissions/guidelines.html (or such other URL as Abc may provide for this purpose from time to time).
9.3 만일 귀하가 Abc와 별도로 서면 계약을 체결하여 이러한 브랜드 특성(brand features)을 이용할 수 있는 명시적인 권리를 부여받은 경우에는, 귀하는 그 계약, ‘약관’의 해당 규정 및 수시로 업데이트되는 Abc의 브랜드 특성 이용 가이드라인에 따라 그러한 특성을 이용하기로 합니다. 이러한 가이드라인은 http://www.abc.co.kr/permissions/guidelines.html(또는 Abc가 수시로 이 목적을 위하여 제공하는 다른 URL)에서 온라인 상으로 볼 수 있습니다.
13.2 If you want to terminate your legal agreement with Abc, you may do so by (a) notifying Abc at any time and (b) closing your accounts for all of the Services which you use, where Abc has made this option available to you. Your notice should be sent, in writing, to Abc’s address which is set out at the beginning of these Terms.
