Korea (hereinafter referred to as "ABC") and XYZ Co., Ltd.,
a corporation duly organized and existing under the laws of
the States of North Carolina, U.S.A and having its principal
office at C.P.O Box No. 211-1, Sanford, NC, 777-1234, U.S.A
(hereinafter referred to as " XYZ"),
이 판매점 계약서(이하 계약서라 칭함)는 1998년 9월15일 대한민국
서울에서 대한민국의 법률에 의해 설립되고 본사가 대한민국 서울시
종로구 사서함 번호 112-1에 소재한 ABC주식회사 (이하 ABC라 칭함)와
미국 북 캐롤라이나 (North Carolina)주 법률에 의해 설립되고
본사가 미국 북 캐롤라이나 주 샌포드(Sanford) 사서함 번호 211-1에
소재하는XYZ주식회사 (이하 XYZ라 칭함)간에 체결된다.

10.1 Abc는 귀하에게 제공하는 ‘서비스’의 일부로서 Abc가 귀하에게 제공하는 소프트웨어(이하, “소프트웨어”)를 이용할 수 있는 개인적인, 전세계적인, 사용료 부담 없는(무상), 이전 불가능한 그리고 비독점적인 라이센스를 귀하에게 허락합니다. 이 라이센스는 ‘약관’에 의하여 허용되는 방식으로, Abc가 제공하는 바에 따라 ‘서비스’를 귀하가 이용하고 그 이익을 누릴 수 있도록 하기 위한 목적에 한정됩니다.

11.1 You retain copyright and any other rights you already hold in Content which you submit, post or display on or through, the Services. By submitting, posting or displaying the content you give Abc a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive licence to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute any Content which you submit, post or display on or through, the Services. This licence is for the sole purpose of enabling Abc to display, distribute and promote the Services and may be revoked for certain Services as defined in the Additional Terms of those Services.
11.1 귀하는 ‘서비스’ 상에 또는 ‘서비스’를 통하여 귀하가 제출, 게시 또는 전시한 ‘콘텐츠’에 관하여 이미 귀하가 가지고 있는 저작권 및 기타 모든 권리를 계속 보유합니다. ‘콘텐츠’를 제출, 게시 또는 전시함으로써, 귀하는 ‘서비스’ 상에 또는 ‘서비스’를 통하여 귀하가 제출, 게시 또는 전시한 ‘콘텐츠’를 복제, 각색, 수정, 번역, 발행, 공연, 전시 및 배포할 수 있는 영구적이고, 철회 불가능하고, 전세계적이고, 실시료 없고(무상), 비독점적인 라이센스를 Abc에 허가합니다. 이 라이센스는 Abc가 ‘서비스’를 전시, 배포 및 촉진할 수 있도록 하는 목적에 한정되고, 그러한 ‘서비스’의 ‘추가 약관’에 정의된 바와 같은 특정 ‘서비스’에 대하여는 취소될 수 있습니다.

20.7 The Terms, and your relationship with Abc under the Terms, shall be governed by the laws of the State of California without regard to its conflict of laws provisions. You and Abc agree to submit to the exclusive jurisdiction of the courts located within the county of Santa Clara, California to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Abc shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
20.7 ‘약관’, 그리고 ‘약관’상의 Abc와 귀하의 관계는 캘리포니아 주 법률(국제사법은 제외)의 적용을 받습니다. 귀하와 Abc는 ‘약관’으로부터 발생하는 모든 법적 문제를 해결하기 위하여 캘리포니아 산타 클라라(Santa Clara) 카운티 내에 소재하는 법원을 전속적 관할법원으로 하기로 합니다. 다만, 위 규정에 불구하고, 귀하는, Abc가 여전히 어느 국가에서든지 보전처분(또는 그에 상당하는 형태의 긴급한 법적 구제수단)을 신청할 수 있다는데 동의합니다.
