But one thing for sure is that once the daughter gets married

Therefore she literally becomes an outsider to her natal family

'밥' is the most important food and Koreans have it for breakfast
lunch, and dinner, in contrast to western meals where certain fo-

Because rice itself tastes bland it is consumed with '김치' '국'

Koreans eat a whole bowl full of rice and they consider it to be
the main food in any given meal. Without rice, one cannot have a

The next important food and porbably the most famous Korean food

powder, salt, garlic, ginger, and a few other ingredients.

Thirdly '국' or soup is usually seved with rice and '김치' It can
be prepared to taste bland or hot and a very popular soup called

These three foods '밥' '김치' and '국' are considered to be esse-
ntial components of a Korean meal.

Along with these foods however, many other '반찬' made of mostly
vegetables and some meat, crowd the table and offer alternative

Arms-length Transactions (between affiliates)

Generally, the Department may use transactions between affiliates as a basis for normal value,
cost of production, and constructed value only if the transactions are at arms length. Arms-length
transactions are those in which the selling price between the affiliated parties is comparable to
the selling prices in transactions involving persons who are not affiliated. The Department
accounts for terms of sale, conditions of delivery, and other circumstances related to the sales in
deciding if the selling prices are comparable. Sales not made at arms-length are considered to be
outside the ordinary course of trade.

일반적으로 상무부는 특수관계인간의 거래가 정상거래인 경우에는 그
거래를 정상가격, 생산원가 및 구성가격의 기초로 사용할 수 있다. 정상
거래란 특수관계인간의 판매가격이 제3자와의 거래가격과 같은 수준일
경우의 거래를 말한다. 상무부는 판매조건, 인도조건 및 판매환경 등을
고려하여 정상적인 판매가격 여부를 판단하게 된다. 정상적인 거래가 아닌
경우에는 통상적인 거래가 아닌 것으로 본다.
Direct vs. Indirect Expenses

In calculating and adjusting normal value, the Department treats selling expenses differently
depending on whether they are direct expenses or indirect expenses. For instance,
circumstances-of-sale adjustments normally involve only direct expenses (and assumptions of
expenses on behalf of the buyer, see below) while the constructed export price offset involves
indirect expenses.

Direct expenses generally must be (1) variable and (2) traceable in a company's financial records
to sales of the merchandise under investigation.
-
1. Variable vs. fixed expenses: Direct expenses are typically variable expenses that are incurred
as a direct and unavoidable consequence of the sale (i.e., in the absence of the sale these
expenses would not be incurred). Indirect expenses are fixed expenses that are incurred
whether or not a sale is made.
-
The same expense may be classified as fixed or variable depending on how the expense is
incurred. For example, if an exporter pays an unaffiliated contractor to perform a service,
this fee would normally be considered variable and treated as a direct expense (provided that
condition 2, below, is also satisfied). However, if the exporter provides the service through a
salaried employee, the fixed salary expense will be treated as an indirect expense.

2. Tying of the expense to sales of the merchandise under investigation: Selling expenses must
be reasonably traceable to sales of the merchandise under investigation to qualify as direct
selling expenses. However, a fixed expense remains indirect even if allocable to the
merchandise under investigation

Common examples of direct selling expenses include credit expenses, commissions, and the
variable portions of guarantees, warranty, technical assistance, and servicing expenses. Common
examples of indirect selling expenses include inventory carrying costs, salesmen's salaries, and
product liability insurance. The Department also classifies the fixed portion of expenses, such as
salaries for employees who perform technical services or warranty repairs, as indirect expenses.

The Department treats assumptions of a customer's expenses as if they were direct expenses,
provided they are attributable to a later sale of the merchandise by the customer. For example,
the Department considers expenses incurred for advertising aimed at retailers to be assumptions
when the exporter is selling to wholesalers. (Section 351.404(d) of the regulations).

정상가격을 산정함에 있어서 상무부는 판매비가 직접비냐 간접비냐에
따라 조정방법을 달리 하고 있다. 예를 들면 판매환경차이 조정은 대개
직접비(또는 구매자를 대신하여 부담하는 비용)만을 대상으로 하고 구성
수출가격 상계는 간접비만을 대상으로 한다.
직접비는 일반적으로 ①조사대상물품의 매출액과 관련하여 변동비적
성격을 가지면서, ②회사의 회계기록상 추적 가능한 것이어야 한다.

1. 변동비와 고정비 : 직접비는 제품매출에 필수적이며 직접적인 관련
을 가지는(즉, 매출이 없으면 발생하지 않는) 전형적인 변동비이다. 간접
비는 매출과 무관하게 발생하는 고정비이다. 같은 성격의 비용도 그
비용이 발생하는 형태에 따라 고정비가 될 수도 있고 변동비가 될 수도

2. 비용과 조사대상물품의 판매와의 연계성 : 판매비는 조사대상물품의
판매와 합리적으로 연계성을 가져야 직접판매비가 될 수 있다. 그러나
고정비는 조사대상물품에 배분될 수 있는 성격을 가지고 있다고 하더라
도 간접비로 본다.

직접판매비로는 신용비용, 판매수수료, 품질보증비, 기술지원비 및 서비
스비용의 변동비 부분을 들 수 있다. 간접판매비로는 재고유지비용,
판매사원에 대한 급여 및 제품책임보험료 등을 들 수 있다. 상무부는
또한 기술지원과 품질보증수리를 담당하는 종업원에 대한 급여와 같은
고정비도 간접비로 분류한다.

상무부는 거래처의 장래의 판매에 기여하는 비용을 대신 부담하는
부분도 직접판매비로 취급한다. 예를 들면 상무부는 수출자가 도매상을
상대로 판매를 하는 경우 소매상을 대상으로 하는 광고비는 거래처를
대신하여 부담하는 비용으로 본다. (규칙(19 CFR) 351.404(d) 참조)
Movement Expenses

Movement expenses are expenses directly attributable to bringing the merchandise from the
original place of shipment to the place of delivery of the U.S. or foreign market sale. These
expenses may include freight and freight insurance charges, brokerage and handling fees, export
taxes, and warehousing expenses incurred after the merchandise leaves the original place of
shipment.

Normally, the product facility is considered to be the original place of shipment. However,
where export price, constructed export price, or normal value is based on a sale made by a
reseller unaffiliated with the producer, the Department may treat the place from which the
reseller shipped the merchandise as the original place of shipment. Sections 772)c)(2)(A) and
773(a)(6)(B)(ii) of the Act; section 351.401(e) of the regulations.)

After the team meeting with the OD, you should inform the petitioner of all problems
found as result of our review. You should state that the listing of problem areas is
advisory and that additional problems, if found after the petition is officially filed, will
have to be corrected during the 20-day statutory initiation period. Remember that 19 CFR
351.202(b) specifies that information supplied in a petition must be "reasonably
available" to the petitioner. There is no exact interpretation of this term, however, the
size of the petitioning firm and the type of information in question should be considered
when these types of judgements are made.
국장과의 협의후, 신청자에게 검토결과 발견된 문제점에 대하여 알려
주어야 한다. 문제점에 대한 지적은 권고하는 것에 불과하고, 정식으로
신청서가 제출된 후에 추가적인 문제점이 발견되면 20일간의 법정 조사

A. Establishing Business Proprietary treatment of Information
A. 정보의 영업비밀 취급 확정
Section 351.304 sets forth rules concerning the treatment of business proprietary
information in general. Paragraph (a) is a general provision. Paragraph (a)(1) provides
persons with the right to request (i) that certain information be considered business
proprietary, and (ii) that certain business proprietary information be exempt from
disclosure under APO. Consistent with section 777(c)(1)(A) of the Tariff Act of 1930
(the Act), paragraph (a)(2) provides that, as a general matter, the DOC will require that all
business proprietary information be disclosed to authorized applicants, with the exception
of (i) customer names in an investigation; (ii) information for which the DOC finds there
is a clear and compelling need to withhold from disclosure; and (iii) classified or
privileged information.

All business proprietary information must be stored in file cabinets, desk drawers or
boxes to the extent possible. When business proprietary data is left in offices which are
not occupied by an analyst at the time, the office door should be locked.
제351.304조는 영업비밀정보의 취급에 관한 규칙을 설명하고 있다. (a)항은
일반적인 조항이다. (a)(1)항은 제출자에게 (i)어떤 정보가 영업비밀이어야
하고 (ii)어떤 영업비밀정보가 APO하에서도 공개되지 않아야 한다고 요청할
권리를 부여하고 있다. 1930년도 법 제777조(c)(1)(A)에 일치되도록 (a)(2)항
에서는 일반적으로 상무부는 모든 영업비밀정보가 권한 있는 요청자에게 (i)피
해조사 과정에서의 거래처명단, (ii)상무부가 비공개할 명백하고 현존하는 필요성
이 있다고 판단하는 정보, (iii)비밀정보 혹은 특권부여정보를 제외하고는 공개
되어야 함을 요청할 것을 규정하고 있다.

모든 영업비밀정보는 가능한 파일 캐비닛이나, 책상서랍이나 박스에 보관 되어
져야 한다. 조사관이 외출중일때에 영업비밀자료가 사무실에 남겨져 있는
경우에는 사무실 문을 잠가야 한다.
제4조 ①이 헌법시행 당시의 공무원과 정부가 임명한 기업체의 임원은 이 헌법에 의하여 임명된 것으로 본다. 다만, 이 헌법에 의하여 선임방법이나 임명권자가 변경된 공무원과 대법원장 및 감사원장은 이 헌법에 의하여 후임자가 선임될 때까지 그 직무를 행하며, 이 경우 전임자인 공무원의 임기는 후임자가 선임되는 전일까지로 한다.
Article 4
(1) Public officials and officers of enterprises appointed by the Government, who are in office at the time of the enforcement of this Constitution, shall be considered as having been appointed under this Constitution: Provided, That public officials whose election procedures or appointing authorities are changed under this Constitution, the Chief Justice of the Supreme Court and the Chairman of the Board of Audit and Inspection shall remain in office until such time as their successors are chosen under this Constitution, and their terms of office shall terminate the day before the installation of their successors.
②이 헌법시행 당시의 대법원장과 대법원판사가 아닌 법관은 제1항 단서의 규정에 불구하고 이 헌법에 의하여 임명된 것으로 본다.
(2) Judges attached to the Supreme Court who are not the Chief Justice or Justices of the Supreme Court and who are in office at the time of the enforcement of this Constitution shall be considered as having been appointed under this Constitution notwithstanding the proviso of paragraph (1).
③이 헌법중 공무원의 임기 또는 중임제한에 관한 규정은 이 헌법에 의하여 그 공무원이 최초로 선출 또는 임명된 때로부터 적용한다.
(3) Those provisions of this Constitution which prescribe the terms of office of public officials or which restrict the number of terms that public officials may serve, shall take effect upon the dates of the first elections or the first appointments of such public officials under this Constitution.
마. 관(管)
(e) Tubes and pipes
"관(管)"이란 전체 길이에 걸쳐 하나의 중공(中空)을 가지는 제품으로서 코일 모양인지에 상관없고 그 횡단면이 균일하며, 원형ㆍ타원형ㆍ직사각형(정사각형을 포함한다)ㆍ정삼각형ㆍ볼록정다각형 모양으로서 그 벽의 두께가 균일한 것을 말한다. 횡단면이 직사각형(정사각형을 포함한다)ㆍ정삼각형ㆍ볼록정다각형인 물품은 전체 길이를 통하여 모서리가 둥근 모양일수도 있는데, 횡단면의 내측과 외측이 동심(同心)이고 동일한 모양과 방향성을 가지고 있는 경우에는 관(管)으로 본다. 위와 같은 횡단면을 가진 관(管)들은 연마한 것, 도포한 것, 구부린 것, 나선가공한 것, 구멍을 뚫은 것, 웨이스트한(waisted) 것, 익스팬디드한(expanded) 것, 원추형으로 한 것, 플랜지(flange)·고리·링을 붙인 것도 있다.
Hollow products, coiled or not, which have a uniform cross-section with only one enclosed void along their whole length in the shape of circles, ovals, rectangles (including squares), equilateral triangles or regular convex polygons, and which have a uniform wall thickness.Products with a rectangular (including square), equilateral triangular or regular convex polygonal cross-section, which may have corners rounded along their whole length, are also to be considered as tubes and pipes provided the inner and outer cross-sections are concentric and have the same form and orientation. Tubes and pipes of the foregoing cross-sections may be polished, coated, bent, threaded, drilled, waisted, expanded, cone-shaped or fitted with flanges, collars or rings.
