A European Union appeals court has upheld a landmark antitrust ruling against Microsoft.
유럽연합(EU) 항소 법원이 (EU 잽행위가) 마이크로소프트社(MS)에 부과한 획기적인 반독점 제재 명령을 지지했습니다.

Microsoft was hoping to delay the EU's original ruling, saying it would cause irreparable damage to the company.
MS는 이러한 제재 조치가 자사에 회복 불가능한 손실을 입힐 수 있다며 EU 집행위가 앞서 내린 시정 명령의 유예를 바랐습니다.
But the Luxemburg-based appeals court threw out that claim.

대법원 2부는 29일 제주의료원 간호사 A씨 등 4명이 근로복지공단을 상대로 제기한 요양급여반려처분취소 소송 상고심 선고에서 사건을 서울고법으로 파기환송했다.
The second division of the Supreme Court sent the case to the Seoul High Court on the 29th, in the court of appeals against Korea Workers' Compensation and Welfare Service for cancelling the disposition for medical care benefits filed by four people, including nurse A, from the Jeju Medical Center.

하지만 항소심 재판부는 메르스 전파에 대한 병원 측과 보건당국의 책임을 인정하면서도 A씨 사망과 관련해 직접적인 인과관계가 있다고 보기는 어렵다고 판단했다.
The appeals court, however, acknowledged the hospital and health authorities' responsibility for the spread of MERS, but judged that it was difficult to say that there was a direct causal relationship regarding the death of A.

최근 서울중앙지법 항소부는 104번 환자 유족들이 일부 승소한 원심을 깨고 원고 패소 판결을 했다.
Recently, the appeals department of the Seoul Central District Court ruled against the plaintiff after breaking some prevailing court cases by the bereaved family of Patient 104.

Reducing the financial risk from such litigation, according to legal
experts, should be a powerful incentive for Microsoft to seek an
out-of-court settlement in the government case. The chances of a
settlement appeared to increase last Friday when Jackson appointed
Richard A. Posner, a federal appeals court judge and leading antitrust
scholar, as mediator in settlement talks between Microsoft and the
Justice Department and the states.
법률 전문가들은 이를 달리 보면 앞으로 예상되는 민간인 손해배상소송의
엄청난 부담이 마이크로소프트가 연방정부와 법정외 화해를 할 수 밖에 없게
만드는 강력한 촉진제로 작용하게 될 것이라고 분석했다. 미 연방법원 잭
슨판사가 지난 19일 고등법원판사이자 반독점법의 권위자인 리처드
포스너씨를 마이크로소프트와 법무부-주정부간의 중재 판사로 임명하면서
법정외 화해 가능성은 높아지고 있다.

In May, 1997, IA published the final revisions of the AD regulations
to reflect the changes made by the URAA. The CVD regulations are
currently being revised. IA's AD and CVD determinations are reviewable
by two federal courts of special jurisdiction, the U.S. Court of
International Trade and the Court of Appeals for the Federal Circuit.
수입행정실은 URAA에 의해 변경된 부문을 반영하기 위해 AD규정을 97
년 5월 최종 수정하였다. CVD규정은 현재 개정작업중이다. 수입행정실의
AD 및 CVD판정은 미국 국제무역법원 (Court of International Trade)과 연방
항고법원(Court of Appeals for the Federal Circuit)등 특별한 처리권한을
지닌 2개의 연방법원에 의하여 재검토될 수 있다.

제107조 ①법률이 헌법에 위반되는 여부가 재판의 전제가 된 경우에는 법원은 헌법재판소에 제청하여 그 심판에 의하여 재판한다.
Article 107
(1) When the constitutionality of a law is at issue in a trial, the court shall request a decision of the Constitutional Court, and shall judge according to the decision thereof.
②명령·규칙 또는 처분이 헌법이나 법률에 위반되는 여부가 재판의 전제가 된 경우에는 대법원은 이를 최종적으로 심사할 권한을 가진다.
(2) The Supreme Court shall have the power to make a final review of the constitutionality or legality of administrative decrees, regulations or actions, when their constitutionality or legality is at issue in a trial.
③재판의 전심절차로서 행정심판을 할 수 있다. 행정심판의 절차는 법률로 정하되, 사법절차가 준용되어야 한다.
(3) Administrative appeals may be conducted as a procedure prior to a judicial trial. The procedure of administrative appeals shall be determined by Act and shall be in conformity with the principles of judicial procedures.
