Critical circumstances are alleged if a petitioner thinks that an exporter or producer has
started to export abnormally high volumes of merchandise as soon as it is known that an
antidumping petition has been filed or an investigation is underway. An exporter or
producer could be doing this to blunt the effects of a preliminary affirmative
determination of sales at less than fair value and the potential for dumping duty liabilities
on entries filed after that date (see Chapter 10).
긴급상황이란 제소자가 생각하기에 생산자나 수출자가 반덤핑조사 신청이
있었다는 사실이나 반덤핑조사가 시작되었다는 것을 알고 갑자기 수출량
을 급격히 증가시킬 경우에 주장할 수 있다. 수출자나 생산자는 공정가격
이하 판매의 예비긍정판정 및 예비판정후 반덤핑관세부과의 효과를 경감
시키기 위하여 이러한 행위를 할 수 있다(제10장 참조).
