Mutiny Aboard Fishing Vessel : 원양어선 선상반란
We are stunned by the shocking mutiny aboard a tuna fishing
boat with a crew of 24 in the South Pacific that has left seven Koreans
and four men from other countries dead. The mishap took place aboard
the 294-ton Honduras-registered Pescamar 15 that was owned by an
Omani firm and operated by Daehyon Fisheries Co. of South Korea. The
victims reportedly were the Korean captain, six other Koreans, three
Indonesians and one Chinese.
우리는 24명의 선원이 승선한 참치잡이어선에서 7명의 한국인과 4명의 외
국인이 사망한 충격적인 선상반란사건을 듣고 놀라움을 금할 수가 없다. 이
사건은 오만 회사의 소유로 온두라스국적이며 한국의 대현 어업에서 조업중
인 294톤의 페스카마 15호 선상에서 일어났다. 희생자들은 한국인 선장, 다

It is to be noted that working in the deep-sea fishing industry has
been unpopular since the 1980s due to the relative low wages and hard
work conditions. In this situation, the government has already allowed
fishing firms to hire foreign workers in numbers up to one-half of their
ships' crew. But domestic companies are hiring up to 80 percent of their
crewmen overseas and could be employing men of dubious
backgrounds.
원양어선 조업이 1980년 이후 상대적으로 낮은 임금과 힘든 작업조건으로
인해 인기를 잃고 있는 업종이라는 것을 유념할 필요가 있다. 이런 상황에
서, 정부는 외국인의 고용을 전체 정원의 반까지 이미 허용한 바 있다. 그러
나 국내 회사들은 원양어선 선원의 80%까지 외국인으로 채용하고 있는 실
정으로 신원이 의심스러운 사람도 채용할 수 있는 가능성을 내포하고 있다.

Why Seize Korean Vessels?
중국과 일본이 아직 경계 합의를 보지 못한 일종의 '중간바다' 에서 조업하던
한국어선 2척을 일본이 나포한 것은 독선적 논리에 빠진 비우호적 행위다.
Japan's recent seizure of Korean fishing vessels in the area where neither Japan
nor China has agreed upon their dominion is hostile conduct completely lacking
in a clear legal foundation.
법적으로도 근거가 미약하고 한국어선에 대한 중국의 호혜적 조치에 비해서도
속좁은 행동이다.
China is not protesting that Koreans are working in the joint fishing zone, but
Japan has taken it upon itself to act as the zones' policeman.
문제가 된 바다는 중국과 일본이 어업협정을 협상하면서 양국의 잠정조치수역
(일종의 공동어로구역) 으로 설정한 곳이다.
이곳에서 제3국 어선이 어떻게 조업하느냐는 복잡한 문제다.
그런데 중.일어업협정은 아직 발효가 되지 않고 있으니 다른 논리로 이를 살펴야
한다. 협정발효 전이니 이곳은 현재로는 유엔 해양법상의 새로운 질서가
채 마련되지 않은 '충돌지역' 이다.
The troubled area is Japan and China's joint fishing zone. It is admittedly hard
to justify how a third country, Korea, can fish there. But because the
Japan-China fishery pact has not yet been ratified the area is an open area.
일본은 댜오위다오 (釣魚島.일본명 센카쿠열도) 를 기점으로 경제수역의 경계를
주장하면서 한국어선이 머무른 곳이 자기네 바다라는 논리를 펴고 있다.
그러나 잘 알려진 대로 댜오위다오는 중국과 일본간에 영유권분쟁이 진행되는
곳이다.
때문에 이를 어느 나라 소속이라고 판단하지 않는다면 다음의 기준은
오키나와섬이 되고 이럴 경우 한국어선이 머무르던 곳은 일본보다 중국쪽의
바다였다.
그러므로 한국이 제3국의 지위로 조업할 경우 상대해야 할 대상은 오히려
중국이라 할 것이다.
Japan insists that its exclusive economic zone(EEZ) begins at Diao Yu Island
(Senkaku Island in Japanese), so Korea cannot engage in fishing there. It has
little reason to back its claim, though.
The area is well known as the place where China and Japan are asserting
respectively as their own territory. Technically, the area where one seized
Korean fishing boat was working belonged to China. Therefore, China rather
than Japan is the country that Korea should answer to.
According to the new fishery agreements between Korea and Japan, starting
from February 19, Korean boats are allowed to fish within certain limits and
catch sizes in Japan's exclusive economic zone.
한.일어업협정에 따라 19일부터는 한국어선이 일정 규모 (통보한 범위내) 로
일본측 경제수역에서 조업하는 것이 보장되는 데도 며칠 앞서 나포라는 자극적
조치를 취한 것이다.
This was partly due to stronger ties between Korea and Japan made through
President Kim Dae Jung's visit to Japan last year.

other's approval and understanding.
