Arms-length Transactions (between affiliates)

Generally, the Department may use transactions between affiliates as a basis for normal value,
cost of production, and constructed value only if the transactions are at arms length. Arms-length
transactions are those in which the selling price between the affiliated parties is comparable to
the selling prices in transactions involving persons who are not affiliated. The Department
accounts for terms of sale, conditions of delivery, and other circumstances related to the sales in
deciding if the selling prices are comparable. Sales not made at arms-length are considered to be
outside the ordinary course of trade.

특수관계인간의 정상거래(Arms-length Transactions (between affiliates))

일반적으로 상무부는 특수관계인간의 거래가 정상거래인 경우에는 그
거래를 정상가격, 생산원가 및 구성가격의 기초로 사용할 수 있다. 정상
거래란 특수관계인간의 판매가격이 제3자와의 거래가격과 같은 수준일
경우의 거래를 말한다. 상무부는 판매조건, 인도조건 및 판매환경 등을
고려하여 정상적인 판매가격 여부를 판단하게 된다. 정상적인 거래가 아닌
경우에는 통상적인 거래가 아닌 것으로 본다.
FAS(Free Alongside Ship) 선측 인도조건
물품이 지정선적항의 부두에서 또는 부선으로 선측에 인도완료되었을 때
매도인의 인도의무가 완료됨.
Seller fulfills his obligations to deliver when the goods have been
placed alongside the vessel on the quay or in lighters at the named
port of shipment.
C&F, CFR(Cost and Freight) 운임포함 인도조건
매도인이 지정된 목적항까지 물품을 운반하는데 필요한 비용 및 운임을
지급하여야 함.
Seller must pay the cost and freight necessary to bring the goods
to the named port of destination.
