Third-Country Market

When the Department cannot use home market sales as the basis for determining normal value,
one of the alternative methods authorized by the antidumping law is the use of sales to
a third-country market, i.e., export sales of the foreign like product to a country other than the United
States. Generally, in selecting a third-country market to be used as the comparison market, the
Department will choose one of the three third-country markets with the largest aggregate quantity
of sales of the foreign like product. In selecting which country, the Department will consider
product similarity, the similarity of the third-country and U.S. markets, and whether the sales to
the third country are representative. (See also Home Market and Viability and section 773(a)(1)
of the Act and section 351.404 at the regulations.)

Section 516(A)(b)(2) of the Act defines the record as consisting of:
(i) a copy of all information presented to or obtained by ... the administering
authority ... during the course of the administrative proceeding, including all
governmental memoranda pertaining to the case and the record of ex parte
meetings required to be kept by [statute]; and
(ii) a copy of the determination, all transcripts or records of conferences or
hearings, and all notices published in the Federal Register.

CHAPTER II ENTRUSTMENT TO FOREIGN COUNTRY
제5조 (촉탁의 상대방) ①외국으로의 촉탁은 수소법원의 재판장이 그 외국의
관할법원 기타 공무소에 대하여 한다.
②수소법원의 재판장은 다음 각호에 따라 외국으로의 촉탁을 할 수 있다.
Article 5 (Other Party of Entrustment)
(1) Any entrustment to a foreign country shall be made by the presiding
judge of the court which has accepted the lawsuit, to the competent court
or other public office of the foreign country.
(2) The presiding judge of the court which has accepted a lawsuit, may make
an entrustment to a foreign country by the following subparagraphs:
1. 송달받을 자 또는 증인신문을 받을 자가 대한민국 국민으로서
영사관계에관한비엔나협약에 가입한 외국에 거주하는 경우에는 그 외국에

또는의사표시에 위배되지 아니하여야 한다.
2. 외국이 명백한 의사표시로써 승인하는 경우에는 그 의사표시에 따른
실시기관에 대하여 한다.
1.If the person to whom the service is to be made, or who is to undergo an
inquiry, is a national of the Republic of Korea, and resides in a foreign
country which is a member of the Vienna Convention on Consular Relations,
the entrustment shall be made to the ambassador, minister or consul of the
Republic of Korea in the foreign country. In this case, it shall not be
contrary to the statute or the declaration of intention of the foreign
country; and
2.If the foreign country approves it by an obvious declaration of its
intention, the entrustment shall be made to the agency implementing such
declaration of intention.
제7장 선거관리
CHAPTER VII ELECTION MANAGEMENT
제114조 ①선거와 국민투표의 공정한 관리 및 정당에 관한 사무를 처리하기 위하여 선거관리위원회를 둔다.
Article 114
(1) The Election Commissions shall be established for the purpose of fair management of elections and national referenda, and dealing with administrative affairs concerning political parties.
②중앙선거관리위원회는 대통령이 임명하는 3인, 국회에서 선출하는 3인과 대법원장이 지명하는 3인의 위원으로 구성한다. 위원장은 위원중에서 호선한다.
(2) The National Election Commission shall be composed of three members appointed by the President, three members selected by the National Assembly, and three members designated by the Chief Justice of the Supreme Court. The Chairman of the Commission shall be elected from among the members.
③위원의 임기는 6년으로 한다.
(3) The term of office of the members of the Commission shall be six years.
④위원은 정당에 가입하거나 정치에 관여할 수 없다.
(4) The members of the Commission shall not join political parties, nor shall they participate in political activities.
⑤위원은 탄핵 또는 금고이상의 형의 선고에 의하지 아니하고는 파면되지 아니한다.
(5) No member of the Commission shall be expelled from office except by impeachment or a sentence of imprisonment without prison labor or heavier punishment.
⑥중앙선거관리위원회는 법령의 범위안에서 선거관리·국민투표관리 또는 정당사무에 관한 규칙을 제정할 수 있으며, 법률에 저촉되지 아니하는 범위안에서 내부규율에 관한 규칙을 제정할 수 있다.
(6) The National Election Commission may issue, within the limit of Acts and decrees, regulations relating to the management of elections, national referenda, and administrative affairs concerning political parties and may also establish regulations relating to internal discipline that are compatible with Act.
⑦각급 선거관리위원회의 조직·직무범위 기타 필요한 사항은 법률로 정한다.
(7) The organization, function and other necessary matters of the Election Commissions at each level shall be determined by Act.
제8장 지방자치
CHAPTER VIII LOCAL AUTONOMY
제117조 ①지방자치단체는 주민의 복리에 관한 사무를 처리하고 재산을 관리하며, 법령의 범위안에서 자치에 관한 규정을 제정할 수 있다.
Article 117
(1) Local governments shall deal with administrative matters pertaining to the welfare of local residents, manage properties, and may enact provisions relating to local autonomy, within the limit of laws and regulations.
②지방자치단체의 종류는 법률로 정한다.
(2) The types of local governments shall be determined by Act.
제5조 이 헌법시행 당시의 법령과 조약은 이 헌법에 위배되지 아니하는 한 그 효력을 지속한다.
Article 5
Acts, decrees, ordinances and treaties in force at the time this Constitution enters into force, shall remain valid unless they are contrary to this Constitution.
