제12조 (공조의 요건) 외국으로부터의 촉탁에 대한 사법공조는 그 촉탁이 다음
각호의 요건을 갖춘 경우에 한하여 이를 할 수 있다.
Article 12 (Requirements for Mutual Cooperation)
Any judicial cooperation with respect to an entrustment by a foreign
country may be given only when it conforms to the following subparagraphs'
requirements:
1. 촉탁법원이 속하는 국가와 사법공조조약이 체결되어 있거나 제4조의 규정에
의한 보증이 있을 것
1. That a judicial cooperation treaty is concluded with the country to
which the entrusting court belongs, or there is a guarantee as provided in
Article 4;
2. 대한민국의 안녕질서와 미풍양속을 해할 우려가 없을 것
2. That it will not be detrimental to public peace and order and good
public morals in the Republic of Korea;
3. 촉탁이 외교상의 경로를 거칠 것
3. That the entrustment is made through diplomatic channel;
4. 송달촉탁은 송달받을 자의 성명·국적·주소 또는 거소를 기재한 서면에 의할
것
4. That the entrustment of service is made in writing specifying the name,
nationality, address or residence of the person to be served;
5. 증거조사촉탁은 소송사건의 당사자, 사건의 요지, 증거방법의 종류,
증인신문의 경우에는 신문받을 자의 성명·국적·주소 또는 거소와 신문사항을
기재한 서면에의할 것
5. That the entrustment of evidence examination is made in writing
specifying the party, summary of case, methods of evidence, or the name,
nationality, address or residence of the person to be inquired and matters
to be inquired, in a case of witness inquiry;
6. 국어로 작성된 번역문이 첨부되어 있을 것
6. That a translation in the Korean language is appended; and
7. 촉탁법원이 속하는 국가가 수탁사항의 실시에 필요한 비용의 부담을 보증할
것
7. That the country to which the entrusting court belongs, guarantees the
payment of expenses needed for implementing the entrusted matters.
