The hacker cracked software sold by a U.S. company, Xing Technology Corp,
that allowed computers to read DVDs. Xing has since been suspended from
DVD format licensing.

In addition, to the extent that Your Site is a media player (1) You represent and warrant that You have a valid license to use and distribute such media player (including all content therein, including without limitation any Ads or Ad Units) for the purposes of this Agreement and the Program; and (2) You shall ensure that any media player(s) that constitute the Site shall comply with the terms and conditions set forth herein. You further represent and warrant that each Property and any material displayed therein: (i) comply with all applicable laws, statutes, ordinances, and regulations; (ii) do not breach and have not breached any duty toward or rights of any person or entity including, without limitation, rights of intellectual property, publicity or privacy, or rights or duties under consumer protection, product liability, tort, or contract theories; and (iii) are not pornographic, hate-related or otherwise violent in content.

14. Your Obligation to Indemnify.

You agree to indemnify, defend and hold Abc, its agents, affiliates, subsidiaries, directors, officers, employees, and applicable third parties (e.g. relevant advertisers, syndication partners, licensors, licensees, consultants and contractors) (collectively "Indemnified Person(s)") harmless from and against any and all third party claims, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s), arising out of, related to or which may arise from Your use of the Program, the Property(ies), and/or Your breach of any term of this Agreement.

15. Abc Rights.

You acknowledge that Abc owns all right, title and interest, including without limitation all Intellectual Property Rights (as defined below), in and to the Program (including Abc's ad serving technology, search technology, referral technology, and Brand Features, including implied licenses, and excluding items licensed by Abc from third parties and excluding any third party media player that may comprise the Property), and that You will not acquire any right, title, or interest in or to the Program except as expressly set forth in this Agreement.

9.4 Other than the limited license set forth in Section 11, Abc acknowledges and agrees that it obtains no right, title or interest from you (or your licensors) under these Terms in or to any Content that you submit, post, transmit or display on, or through, the Services, including any intellectual property rights which subsist in that Content (whether those rights happen to be registered or not, and wherever in the world those rights may exist). Unless you have agreed otherwise in writing with Abc, you agree that you are responsible for protecting and enforcing those rights and that Abc has no obligation to do so on your behalf.

10. License from Abc
10. Abc의 라이센스 허가
10.1 Abc gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive licence to use the software provided to you by Abc as part of the Services as provided to you by Abc (referred to as the “Software” below). This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Abc, in the manner permitted by the Terms.

11. Content licence from you

11.1 You retain copyright and any other rights you already hold in Content which you submit, post or display on or through, the Services. By submitting, posting or displaying the content you give Abc a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive licence to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute any Content which you submit, post or display on or through, the Services. This licence is for the sole purpose of enabling Abc to display, distribute and promote the Services and may be revoked for certain Services as defined in the Additional Terms of those Services.

* shrink-wrap license
The term shrink-wrap license refers colloquially to any software license
agreement which is enclosed within a software package and is inaccessible
to the customer until after purchase. Typically, the license agreement is
printed on paper included inside the boxed software. It may also be
presented to the user on-screen during installation, in which case the
license is sometimes referred to as a click-wrap license.
The inability of the customer to review the license agreement before
purchasing the software has caused such licenses to run afoul of legal
challenges in some cases.
