제13조 (촉탁서의 접수) ①외국으로부터의 사법공조촉탁서는 법원행정처장이
이를 접수하여 제11조의 규정에 의한 관할법원에 송부한다.
Article 13 (Reception of Written Entrustment)
(1) Any written entrustment of judicial cooperation prepared by a foreign
country shall be received and sent to the competent court as provided in
Article 11 by the Director of the Court Administration Office.
②법원행정처장은 외국으로부터의 촉탁이 제12조의 규정에 의한 요건을 갖추지
아니한 것으로 인정되는 때에는 이유를 기재하여 이를 반송하여야 한다.
(2) If it is deemed that the entrustment made by the foreign country fails
to meet the requirements as provided in Article 12, the Director of the
Court Administration Office shall return it to the foreign country with the
reason thereof specified.
제14조 (이송) 제13조의 규정에 의하여 사법공조촉탁서를 송부받은 법원은
수탁사항이 그 관할에 속하지 아니할 경우 결정으로 관할법원에 이송하고, 그
사실을법원행정처장에게 통지하여야 한다.
Article 14 (Transfer)
If the entrusted matters do not fall under its jurisdiction, the court
which has received the written entrustment of judicial cooperation under
Article 13, shall transfer it to the competent court, and notify the fact
to the Director of the Court Administration Office.
20.7 The Terms, and your relationship with Abc under the Terms, shall be governed by the laws of the State of California without regard to its conflict of laws provisions. You and Abc agree to submit to the exclusive jurisdiction of the courts located within the county of Santa Clara, California to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Abc shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
20.7 ‘약관’, 그리고 ‘약관’상의 Abc와 귀하의 관계는 캘리포니아 주 법률(국제사법은 제외)의 적용을 받습니다. 귀하와 Abc는 ‘약관’으로부터 발생하는 모든 법적 문제를 해결하기 위하여 캘리포니아 산타 클라라(Santa Clara) 카운티 내에 소재하는 법원을 전속적 관할법원으로 하기로 합니다. 다만, 위 규정에 불구하고, 귀하는, Abc가 여전히 어느 국가에서든지 보전처분(또는 그에 상당하는 형태의 긴급한 법적 구제수단)을 신청할 수 있다는데 동의합니다.
