4. Parties' Responsibilities.

You are solely responsible for the Property(ies), including all content and materials, maintenance and operation thereof, the proper implementation of Abc's specifications, and adherence to the terms of this Agreement, including compliance with the Program Policies.
귀하만이 자산에 대한 책임을 부담하는데, 여기에는 모든 컨텐츠와 자료, 자산 유지보수와 운영, Abc 상세요건의 적절한 이행, 그리고 프로그램 정책 준수를 포함한 본 계약 조항 준수가 포함됩니다.
Abc reserves the right to investigate, at its own discretion, any activity that may violate this Agreement, including but not limited to any use of a software application to access Ads, Links, Search Results, or Referral Buttons or to complete any Referral Event, or any engagement in any activity prohibited by this Agreement.

8) 수시로 개정되며 Abc 웹 사이트에 게시되는 프로그램 정책 또는 귀하와 Abc 사이의 다른 모든 계약 ( Abc 애드워즈 프로그램 약관을 포함하나 이에 한정되지 않음 ) 를 어떠한 방식으로든 위반하는 행위 ;
(x) create a new account to use the Program after Abc has terminated this Agreement with You as a result of your breach of this Agreement; or
10) 귀하가 본 계약을 위반하여 Abc가 본 계약을 종료한 후 프로그램을 이용하기 위하여 새로운 계정을 만드는 행위 ;
You acknowledge that any attempted participation or violation of any of the foregoing is a material breach of this Agreement and that we may pursue any and all applicable legal and equitable remedies against You, including an immediate suspension of Your account or termination of this Agreement, and the pursuit of all available civil or criminal remedies.
귀하는 전술한 어떠한 행위에 참여하거나 위반하려는 시도기 본 계약의 중대한 위반이고, Abc는 귀하 계정의 즉시 중지 또는 본 계약의 종료 및 모든 가능한 민형사상의 구제책을 강구를 포함하여 귀하를 상대로 가능한 모든 합법적이고 정당한 구제책을 취할 수 있음을 인정합니다 .
Abc may investigate any activity that may violate this Agreement.

Except for any indemnification and confidentiality obligations hereunder or your breach of any intellectual property rights and/or proprietary interests relating to the program, (i) in no event shall either party be liable under this agreement for any consequential, special, indirect, exemplary, or punitive damages whether in contract, tort or any other legal theory, even if such party has been advised of the possibility of such damages and notwithstanding any failure of essential purpose of any limited remedy and (ii) Abc's aggregate liability to publisher under this agreement for any claim is limited to the net amount paid by Abc to publisher during the three month period immediately preceding the date of the claim.
본 계약 하의 보상 및 기밀 유지 의무 또는 프로그램 관련 귀하의 지적재산권 및 / 또는 재산권적 이익의 위반의 경우를 제외하고, 1) 본 계약 하에서 일방은 어떠한 경우에도 계약, 불법행위 또는 기타 법리로 인하여 발생하는 손해에 대하여, 일방의 귀책사유 ( 예컨대 고의, 과실 ) 로 인하여 발생하는 상대방에 대한 통상손해 이외의 손해에 대하여는 책임을 부담하지 않습니다.
다만, 일방이 특별한 사정을 알았거나 특별한 사정의 가능성을 합리적으로 알 수 있었을 경우에는 특별손해에 대하여도 책임을 부담합니다. 2) 본 계약 하에서 어떠한 청구의 경우에도 ( 클릭의 유효성과 관련하여 고의로 발생한 손해를 제외하고 ), 일방이 상대방에 대하여 부담하는 전체 책임은, 청구일로부터 직전 3 개월 동안 Abc가 본 계약 하에서 게시자에 지불한 총 금원 ( 상계되지 않은 금원 ) 으로 제한됩니다.
(d) clicks co-mingled with a significant number of invalid clicks described in (a) above, or as a result of any breach of this Agreement by You for any applicable pay period.
4) 위 1) 에 설명된 상당수의 무효 클릭이 혼합된 클릭 또는 해당기간 동안 귀하에 의한 본 계약 위반의 결과로서의 클릭의 경우 .
Abc reserves the right to withhold payment or charge back Your account due to any of the foregoing or any breach of this Agreement by You, pending Abc's reasonable investigation of any of the foregoing or any breach of this Agreement by You, or in the event that an advertiser whose Ads are displayed in connection with Your Property(ies) defaults on payment for such Ads to Abc.

In addition, to the extent that Your Site is a media player (1) You represent and warrant that You have a valid license to use and distribute such media player (including all content therein, including without limitation any Ads or Ad Units) for the purposes of this Agreement and the Program; and (2) You shall ensure that any media player(s) that constitute the Site shall comply with the terms and conditions set forth herein. You further represent and warrant that each Property and any material displayed therein: (i) comply with all applicable laws, statutes, ordinances, and regulations; (ii) do not breach and have not breached any duty toward or rights of any person or entity including, without limitation, rights of intellectual property, publicity or privacy, or rights or duties under consumer protection, product liability, tort, or contract theories; and (iii) are not pornographic, hate-related or otherwise violent in content.
나아가, 귀하의 사이트가 미디어 플레이어인 경우, (1) 귀하는 그러한 미디어 플레이어 ( 광고 또는 광고 단위를 포함하되 이에 한정되지 않고 모든 콘텐츠를 포함 ) 를 본 계약과 프로그램을 위하여 사용하고 배포할 적법 유효한 사용권 ( 라이센스 ) 을 보유하고 있음을 진술하고 보증하며, (2) 귀하는 사이트를 구성하는 어느 미디어 플레이어도 본 계약에서 정한 조건을 준수할 것을 보증합니다. 귀하는 또한 각 자산와 이에 게재된 자료가 i) 모든 해당 법률, 법규, 조례 및 규정을 준수하고, ii) 모든 개인 또는 존재의 권리 또는 그들에 대한 의무 ( 지적 재산권, 퍼브리시티 ( 초상 ) 또는 프라이버시, 소비자 보호 관련 권리 또는 의무, 제조물 책임, 불법 행위 또는 계약 법리 하에서의 권리 또는 의무를 포함하되 이에 국한되지 않음 ) 를 위반하지 않으며 지금까지 위반한 적이 없고, iii) 컨텐츠에 포르노, 증오 관련 또는 기타 폭력성 자료가 없음을 진술하고 보증합니다
14. Your Obligation to Indemnify.

You agree to indemnify, defend and hold Abc, its agents, affiliates, subsidiaries, directors, officers, employees, and applicable third parties (e.g. relevant advertisers, syndication partners, licensors, licensees, consultants and contractors) (collectively "Indemnified Person(s)") harmless from and against any and all third party claims, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s), arising out of, related to or which may arise from Your use of the Program, the Property(ies), and/or Your breach of any term of this Agreement.
귀하는 귀하의 프로그램 및 자산의 이용 및 / 또는 본 계약 조항의 위반으로 인하여 발생하거나 관련되거나 발생할 가능성이 있는 Abc, 대행사, 제휴사, 자회사, 이사, 임직원 및 해당 제 3 자 ( 예컨대, 관련 광고주, 신디케이션 파트너, 라이센서 ( 라이센스 제공자 ), 라이센시 ( 라이센스 수혜자 ), 컨설턴트 및 도급자 ) ( 이하, 총칭하여 " 배상 수혜자 ") 에 대한 모든 제 3 자 청구, 책임, 손실 및 경비 ( 손해 보상금, 합의금 및 합리적인 법률비용 포함 ) 에 관하여, 배상 수혜자의 손해를 배상하고 이들을 변호하며 이들에게 아무런 손해가 없도록 한다는 점에 동의합니다 .
14.1 NOTHING IN THESE TERMS, INCLUDING SECTIONS 14 AND 15, SHALL EXCLUDE OR LIMIT GOOGLE’S WARRANTY OR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
14.1 제14조 및 제15조를 비롯하여 이 ‘약관’의 어떠한 규정도 관련 법률에 의하여 적법하게 배제되거나 제한될 수 없는 손해에 대해서는 Abc의 보증 또는 책임을 배제하거나 제한할 수 없습니다. 일부 국가에서는 과실, 계약위반 또는 묵시적조건위반으로 인한 손해 또는 손실 이나 부수적 또는 결과적 손해에 대해서는 특정의 보증이나 조건부가, 또는 책임의 제한이나 배제를 허용하지 아니합니다. 따라서, 귀하의 국가에서의 적법한 제한만이 귀하에게 적용되며, 저희의 책임은 법률에 의하여 허용되는 최대 한도까지만 제한됩니다.
