During his years as mayor of New York City, Guardia sometimes presided as judge in a night court.
In one case, a man was found guilty of stealing a loaf of bread.
He claimed that he had committed that theft to feed his starving family.
“The law is the law,” La Guardia declared.
“I must therefore fine you $10.”
When the man sadly confessed that he had no money, the judge took $10 out of his wallet and paid the fine.
He also asked each person in the courtroom to contribute 50 cents to help the man.
There and then, they accepted his request.
Finally, the law-breaker was set free and even blessed with an undeserved gift.
New York시의 시장으로 재직하고 있는 동안 Guardia는 때로 야간법정의 판사 역할을 했다.
한번은 어떤 남자가 빵을 훔친 혐의로 유죄 선고를 받았다.
그는 ‘굶고 있는 가족을 먹이기 위해 절도를 했다'고 주장했다.

그 남자가 돈이 없음을 슬프게 고백하자 판사는 지갑에서 10$를 꺼내 벌금을 물어주었다.
그는 법정에 있는 사람들에게 그를 돕기 위해 50센트씩을 기부해줄 것을 요청했다.
그 즉시 사람들은 그의 제안을 받아들였다.
마침내 그 범법자는 석방되고 예상치 못한 선물까지 받는 혜택을 입었다.

But democracy is usually a tumultuous and unseemly affair, especially when men
feel strongly about vital issues. Probably since the first popular assembly convened
there have been presiding officers who turned a deaf ear to delegates they did not
like. Rival factions have always tried to pack the galleries and to shout down their
opponents. To take note of these historical facts is not to condone them. An unending
effort has to be made to create procedural sefeguards strong enough to curb the
ineradicable human impulse to unfairness. But critics should not pretend they were
born yesterday and are innocent of any knowledge of pressure tactics in politics.
그러나 민주주의는 대개 소란스럽고 보기 흉하다. 특히 사람들이 중대한 문제에 대해서
격한 감정을 갖게 될 때에는. 아마도 최초의 민중집회가 소집된 이래로 자기들이
좋아하지 않는 대표들에게는 귀를 기울이지 않는 사회자들이 있어 왔을 것이다.
서로 반대하는 파들이 언제나 방청석을 메우고 상대 대표들의 발언을 봉쇄하려고
해 왔다. 우리가 이러한 역사적 사실에 주의를 기울이는 것이 곧 그것을 용서하는
것은 아니다. 우리는 끊임없이 노력해서 부당한 행동을 하려는 인간의 뿌리를
뽑아 버릴 수 없는 충동을 억제할 만큼 튼튼한 (민주주의 토의) 절차상의 안전책을
마련해야 한다. 그렇지만 이러한 민주주의 방식을 비판하는 사람들은 마치 자기들이
엊그제 태어나서 정치에 있어서의 압력술책을 전혀 모르는 척해서는 안 될 것이다.

제2장 외국으로의 촉탁
CHAPTER II ENTRUSTMENT TO FOREIGN COUNTRY
제5조 (촉탁의 상대방) ①외국으로의 촉탁은 수소법원의 재판장이 그 외국의
관할법원 기타 공무소에 대하여 한다.
②수소법원의 재판장은 다음 각호에 따라 외국으로의 촉탁을 할 수 있다.
Article 5 (Other Party of Entrustment)
(1) Any entrustment to a foreign country shall be made by the presiding
judge of the court which has accepted the lawsuit, to the competent court
or other public office of the foreign country.
(2) The presiding judge of the court which has accepted a lawsuit, may make
an entrustment to a foreign country by the following subparagraphs:
1. 송달받을 자 또는 증인신문을 받을 자가 대한민국 국민으로서
영사관계에관한비엔나협약에 가입한 외국에 거주하는 경우에는 그 외국에
주재하는대한민국의 대사·공사 또는 영사에 대하여 한다. 이 경우 그 외국의 법령
또는의사표시에 위배되지 아니하여야 한다.
2. 외국이 명백한 의사표시로써 승인하는 경우에는 그 의사표시에 따른
실시기관에 대하여 한다.
1.If the person to whom the service is to be made, or who is to undergo an
inquiry, is a national of the Republic of Korea, and resides in a foreign
country which is a member of the Vienna Convention on Consular Relations,
the entrustment shall be made to the ambassador, minister or consul of the
Republic of Korea in the foreign country. In this case, it shall not be
contrary to the statute or the declaration of intention of the foreign
country; and
2.If the foreign country approves it by an obvious declaration of its
intention, the entrustment shall be made to the agency implementing such
declaration of intention.

제6조 (촉탁의 경로) ①외국으로의 촉탁을 하고자 하는 재판장이 속하는 법원
의 장은 법원행정처장에게 촉탁서 기타 관계서류를 송부할 것을 요청하여야 한
다.
Article 6 (Channel of Entrustment)
(1) The head of the court to which the presiding judge of the court who
wishes to make an entrustment to a foreign country belongs, shall request
the Director of the Court Administration Office to send the written
entrustment and other related documents.
②법원행정처장은 외무부장관에게 제1항의 규정에 의한 촉탁서 기타 관계서류
를 외교상의 경로를 통하여 제5조에 규정된 수탁기관으로 송부할 것을 의뢰하
여야 한다.
(2) The Director of the Court Administration Office shall request the
Minister of Foreign Affairs to send the written entrustment and other
related documents as provided in paragraph (1) to the entrusted agency as
provided in Article 5, through a diplomatic channel.

제91조 ①국가안전보장에 관련되는 대외정책·군사정책과 국내정책의 수립에 관하여 국무회의의 심의에 앞서 대통령의 자문에 응하기 위하여 국가안전보장회의를 둔다.
Article 91
(1) A National Security Council shall be established to advise the President on formulation of foreign, military and domestic policies related to national security prior to their deliberation by the State Council.
②국가안전보장회의는 대통령이 주재한다.
(2) The meetings of the National Security Council shall be presided over by the President.
③국가안전보장회의의 조직·직무범위 기타 필요한 사항은 법률로 정한다.
(3) The organization, function and other necessary matters pertaining to the National Security Council shall be determined by Act.
