한국소비자원 소비자 분쟁조정위원회는 H생명보험사가 고지의무를 위반했다며 A씨와 보험계약을 해지한 사건에 대해 보험계약을 원상회복하라고 결정했다고 3일 밝혔다.
The Consumer Dispute Settlement Committee at the Korea Consumer Agency announced on the 3rd that the life insurance company H violated the obligation to inform. The committee ordered the insurer to restore the insurance contract to its original condition regarding the case the company terminated its contract with A (the insured).
Since the requirements for the submission of factual information by interested parties to
the CRU are clearly stated in the regulations, case analysts must not accept official
filings. Nevertheless, the analyst must insure that such documents are properly filed with
CRU. If you do not receive a date-stamped version within two days, check with CRU to
verify that the document was filed.
이해관계인이 사실정보를 중앙기록관리소에 제출하는 요건이 연방규칙
에 분명히 규정되어 있으므로 사건분석관은 공식 제출서류를 받아서는

1. Documents prepared by individuals involved in a case or administrative
review for their own personal use that are in fact only used by that individual

Note that under 19 CFR 351.303(c)(2)(iii) any proprietary data submitted for the record
by outside parties must be accompanied by a public summary, as defined under that
section. A party cannot submit only a proprietary version for the record. When checking
the completeness of the file, the analyst must insure that all proprietary submissions are
matched to an accompanying public version. The DOC has a similar responsibility for
preparing public versions of memoranda and other documents which contain proprietary
information and are relied upon in making our determination in an investigation or
review.
19CFR 351.303(c)(2)(ⅲ) 조항에서 규정하고 있는 것처럼 외부
이해당사자가 행정기록을 위해 영업비밀자료를 제출할 경우에는
공개요약본을 함께 제출해야 한다. 일방당사자는 행정기록을 위한
영업비밀이 포함된 것만을 제출할 수 없다. 분석관은 자료철이
완전한가를 점검할 때에 모든 영업비밀문건이 공개본과 함께 제출
되었는지를 확인해야 한다. 상무부도 영업비밀정보가 포함되어 있거
나 조사나 행정재심사의 판정시에 활용된 문서나 비망록의 공개본
을 준비해야 할 유사한 책임을 가지고 있다.
It is the responsibility of the APO office to address all claims concerning
a clear and compelling need to withhold business proprietary information from release
subject under the DOC's APO. Analysts should never assume that correspondence
concerning an APO matter in their case is automatically forwarded to the APO office, and
should always insure that a date stamped copy of the correspondence is provided to the
APO office as quickly as possible. A member of the APO office will meet with the
analyst(s), team attorney, and other team members, if necessary, to discuss the matter.
APO Office는 상무부의 행정보호명령(APO)에 따라 영업상의 비밀정보로서
공개가 유보되어야 할 "명백하고 급박한 필요성"과 관련된 모든 주장을 전달
해야 하는 책임을 가지고 있다. 분석관은 담당 케이스에서 APO 문제와 관련
된 모든 서류들이 자동적으로 APO Office에 보내질 것이라는 가정을 해서는
안되며, 접수일자가 날인된 서류의 복사본을 가능한 한 신속히 APO Office에
제출하여야 한다. APO Office 직원은 필요할 경우에 분석관, 팀의 변호사,
팀의 다른 멤버들과 만나서 그 문제를 토론하게 된다.
