조사 또는 행정재심 업무를 담당하는 어느 직원이 보지 못한
문서는 상무부 내의 대리인 또는 기타 사무실의 소유하에 있어도
행정기록에 해당되지 않는다. 또한 조사업무를 담당하는 직원은
다른 부서나 기관이 가지고 있는 정보자료를 확보해야할 의무가
없다.
An APO is the legal mechanism by which the DOC controls the limited disclosure of
business proprietary information to representatives of interested parties. The DOC
authorizes the release of business proprietary information under APO when the
representatives file an application for APO access (FORM ITA-367) in which they agree
to be bound by the terms of the APO. Applicants must:

o use the information only in the segment of the proceeding in which it was
submitted or in which it is authorized for use,
o protect the information from unauthorized disclosure,
o report any violation of the terms of the APO, and
o acknowledge the sanctions that may be imposed should there be a violation of the
terms of the APO.

APO는 상무부가 이해관계자의 대리인에 대하여 영업비밀정보를 제한적으
로 공개할 수 있도록 통제하는 법적 장치이다. 상무부는 대리인이 APO규칙에
의한 구속을 받아들이는 조건으로 APO로의 접근(FORM ITA-367)을 신청
하는 경우 영업비밀정보의 공개를 허가할 권한을 갖는다. APO규칙의 적용을
받는 자들은 다음을 반드시 준수하여야 한다.

ㅇ영업비밀정보는 오직 그것이 제출되거나 그것의 사용이 허가되는 절차에
서만 사용할 수 있다.
ㅇ허가되지 않는 공개로부터 정보를 보호하여야 한다.
ㅇAPO의 조건에 대한 위반을 보고하여야 한다.
ㅇAPO규칙을 위반할 때에는 제재조치가 가해진다는 사실을 인지하여야 한다.
